Explanation

 

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN23-017) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on October 4, 2023. City Council approved a service ordinance addressing the site on October 16, 2023. Franklin County approved the annexation on November 7, 2023 and the City Clerk received notice on November 24, 2023.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

To accept the application (AN23-017) of Melissa & Adam Boals for the annexation of certain territory containing 0.47± acres in Franklin Township.

Body

 

WHEREAS, a petition for the annexation of certain territory in Franklin Township was filed on behalf of Melissa & Adam Boals on October 4, 2023; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on November 7, 2023 and

WHEREAS, on November 24, 2023, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1. That the annexation proposed by Melissa & Adam Boals in a petition filed with the Franklin County Board of Commissioners on October 4, 2023 and subsequently approved by the Board on November 7, 2023 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

The following described .47 acres for the proposed annexation is situated in the State of Ohio, County of Franklin, Virginia Military District, Township of Franklin and being all of Lot Number 13 of Western Estates, as recorded in the Recorder's Plat Book 29, Page 15, being all of the tract of land conveyed to Adam and Melissa Boals [Auditor's Tax Parcel 142-000019-00] by the deed recorded in the Recorder's Instrument Number 201607120088842, and more particularly described as follows:

Beginning at the northwest corner of Lot Number 13 of the Western Estates, and the south line of Lot No. 77 and part of Lot No. 78 of Raspberry Run section 3, as recorded in Recorder's Plat Book 80, Page 90, also being on the existing City of Columbus Corporation Line as established by City Ordinance Number 634-89, as recorded in Recorder's Official Record 13293 H-09; and also being the Northeast corner of Lot Number 12 of the Western Estates.

Thence in a easterly direction, a distance of approximately 135 feet along the common line of Lot Number 13 and Lot Numbers 77, 78, and 79 of Raspberry Run Section 3 (being the south line of the property conveyed to Ali Road Yousef as recorded in Instrument Number 201705170066515, Scott T. Wolslager as recorded in Instrument Number 200509150191999, and Gregory S. and Kathleen A. Evans as recorded in Instrument Number 199606280147644) and also being to the south of Lot Numbers 77, 78, and 79;

Thence in a Southernly direction, a distance of approximately 150 feet along the common line of Lot Number 13 and Lot Number 14 (being the west line of the property conveyed to Sean P. Ivory as recorded in Instrument Number 201706280088003), to the southeast corner of Lot Number 13, and the southwest corner of Lot 14, and the northerly right of way of Ongaro Drive;

Thence in a westerly direction, a distance of approximately 135 feet along the said northerly right of way of Ongaro Drive to the southwest corner of Lot Number 13 and the southeast corner of Lot Number 12;

Thence in a Northerly direction, a distance of approximately 150 feet along the common line of Lot Number 13 and Lot Number 12 (being the east line of property conveyed to Francis F. Schafer as recorded in Instrument Number 199604030092562), to the Point of Beginning of this description, and containing approximately 0.47 Acres of land, more or less.

Total perimeter of annexation area is 570 feet out of which 135 feet is contiguous with the City of Columbus Ord #634-89 Contiguity + 23. 7%.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
