Explanation
BACKGROUND. This legislation authorizes a modification to the design contract with Evans, Mechwart, Hambleton and Tilton, Inc. for the Dry Run Flood Routing at Valleyview Project which is one of the Group 3 Localized Stormwater System Improvements Projects.
This contract modification is necessary to allow payment to Evans, Mechwart, Hambleton and Tilton, Inc. for construction administration and inspection services. These services are typically performed by the Transportation Division; however, due to the specialty type of construction work to be performed it is necessary to have the design consultant perform these services.
EMERGENCY DESIGNATION. Emergency designation is requested for this ordinance so that the construction services will not be delayed. Construction administration and inspection services must be in place in order for the construction phase of the project to begin.
FISCAL IMPACT. There are sufficient funds and spending authority available for this expenditure. The new contract amount including this modification is $2,603,927.95.

To authorize the Director of Public Utilities to modify the contract with Evans, Mechwart, Hambleton and Tilton, Inc. for construction administration and inspection services for the Dry Run Flood Routing at Valleyview Project from the Storm Sewer Bond Fund for the Division of Sewerage and Drainage; to authorize the expenditure of $147,544.68; and to declare an emergency. WHEREAS, it is necessary to modify Contract No. XC817974 to authorize the funds required to allow payment to Evans, Mechwart, Hambleton and Tilton, Inc. for construction administration and inspection services as per the consultant's letter dated June 1, 2004, for the Dry Run Flood Routing at Valleyview Project; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to modify the contract for construction administration and inspection services for the Dry Run Flood Routing at Valleyview Project, for the preservation of the public health, peace, property and safety; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. XC817974, with Evans, Mechwart, Hambleton and Tilton, Inc., 170 Mill Street, Gahanna, Ohio 43230, for professional engineering services to perform construction administration and inspection services for the Dry Run Flood Routing at Valleyview Project in accordance with the terms and conditions as shown in the contract on file in the office of the Division of Sewerage and Drainage.
Section 2. That for the purpose of paying the cost of the contract modification, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows: Storm Sewer Bond Fund, Fund 685, Dept/Div 60-15, OCA Code 685824, Object Level Three 6682, Project No. 610824, Amount $147,544.68.
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
