APPLICANT:  Howard F. & Muriel R. Hedrick; 1065 Georgesville Road; Columbus, OH 43228.
      
PROPOSED USE:  Commercial development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0) on July 10, 2008.
 
GREATER HILLTOP AREA COMMISSION RECOMMENDATION: Approval.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested L-C-3, Limited Commercial District will allow commercial development that is compatible with surrounding commercial uses and districts.  The limitation text contains use restrictions and customary development standards for setbacks, screening, landscaping and lighting controls.  The request is consistent with the zoning and development patterns of the area.

WHEREAS, application #Z08-020 is on file with the Building Services Division of the Department of Development requesting rezoning of 1.1± acres from L-C-2, Limited Commercial District, to L-C-3, Limited Commercial District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the Greater Hilltop Area Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested L-C-3, Limited Commercial District will allow commercial development that is compatible with surrounding commercial uses and districts.  With the proposed limitations, the request is consistent with the zoning and development patterns of the area, now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
1125 GEORGESVILLE ROAD (43228), being 1.1± acres located at the northwest corner of Georgesville and Hall Roads, and being more particularly described as follows:
 
Situated in the State of Ohio, County of Franklin, Township of Franklin, being parts of Virginia Military Survey No. 1425 and No. 13950, aka No. 14506, being the south part of the division of a 1.852 acre tract of land of the Estate of Gladys Albery, deceased, said estate still pending in the Probate Court of Franklin County, Ohio; and the lands of which Gladys Albery claims title to by deed of record in Deed Book 1736, Page 116 of the records in the recorder's office, Franklin County, Ohio, and more particularly described as follows:
 
Commencing at a railroad spike 1.31 feet westerly of the intersection of the centerlines of Georgesville Road and Hall Road, thence with the centerline of Hall Road N 87°13¢31¢¢ W a distance of 148.65 feet to a spangle in the centerline of said road and the TRUE PLACE of beginning;
 
      Thence, continuing with the centerline of said Hall Road N 87°13¢31¢¢ W a distance of 170.10 feet to a spangle;

1. INTRODUCTION:  This site is located along the west side of Georgesville Road, 1.27 ± acres located at the northwest corner of Hall and Georgesville Roads east of vacant lot zoned LC3.  The applicant requests similar uses and development standards for this site.
 
2. PERMITTED USES
 
All uses of the C-3, Commercial District (3355.03, CCC), except the following:
 
Billboards and off-premise graphics, except off-premise graphics as may be permitted by Special Permit from the Columbus Graphics Commission.
 
3. DEVELOPMENT STANDARDS
 
Except as provided herein, the applicable development standards shall be those standards contained in Chapter 3355, C-3, Commercial District, of the Columbus City Codes:
 
A. Density, Height, Lot and/or Setback Commitments:
 
1. Setbacks:
 
a. North Property Line:  The minimum building and parking setback shall be fifteen (15) feet as long as adjacent property to the north is residentially zoned or used.
 
B. Access, Loading, Parking, and/or Other Traffic Related Commitments.
 
1.  The access point on Hall Road shall be limited to right-in/right-out access.  The access point shall be as close to the west property line as possible.
 
2.  The access point on Georgesville Road shall be limited to a right-in/right-out access.  The access point shall be as close to the north property line as possible.
 
3.  At the time of development, the developer shall install a southbound right turn lane on Georgesville Road at the intersection of Hall Road.  The length of the right turn lane shall be 405', which includes a 60' taper.
 
4.  If the property owner acquires the property to the north or if a cross access easement is acquired across the property to the north, the City may, at its option, relocate the access point on Georgesville Road.  The property owner shall receive no compensation for such relocation.
 
5.  If the property owner acquires the property to the west or if a cross access easement is acquired across the property to the west, the City may, at its option, relocate the access point on Hall Road.  The property owner shall receive no compensation for such relocation.
 
C. Buffering, Landscaping, Open Space and/or Screening Commitments:
 
1. Perimeter buffering shall include the following:
 
a. East setback:  The parking setback from Georgesville Road shall include tree planting at the rate of one (1) deciduous street tree per thirty (30) lineal feet of street frontage.
 
b.   North Setback:  As long as the property to the north is residentially zoned or used, the following is required:  Within the 15 foot setback area, a fence or wall shall be provided to a minimum height of five (5) feet and 75% opacity.  The fence or wall shall be located on or near the property lines.  Additionally, a mixture of evergreen and deciduous trees shall be planted thirty (30) feet on center.
 
2. Where fencing is used, such fencing shall be board on board, well maintained and kept free of graffiti.
 
3. Landscaping shall be well maintained.  Diseased or dead plant material that is required by this text shall be replaced within six (6) months.
 
4. Minimum tree sizes at installation shall be as follows:
Deciduous      2 1/2" caliper
Ornamental      1 1/2" caliper
Evergreen      Five (5) feet tall
 
D. Building Design and/or Interior-Exterior Treatment Commitments:
 
1. Ground and roof mounted mechanical equipment shall be fully screened to the height of the equipment with landscaping, fencing, walls, and/or building materials that are consistent with the building materials of the building.
 
E. Dumpsters, Lighting, Outdoor Display Areas and/or Other Environmental Commitments.
 
1. Parking lot lighting shall utilize fully shielded cut-off style (down lighting) fixtures a maximum of 18 feet in height.  Parking lot lighting within 50 feet of adjacent residential zoning shall not exceed 14 feet in height.  There may be accent lighting on landscaping and buildings but all lighting shall be placed and/or shielded to minimize off-site light and glare.  No parking lot light poles shall be located in the north setback areas.
 
2. All wall mounted area lighting, exclusive of decorative lighting, shall utilize fully shielded cut-off style (down lighting) fixtures.
 
3. All parking lot light poles and area lighting fixtures used shall be from the same or similar manufacturer's type to insure aesthetic compatibility.
 
F. Graphics and Signage Commitments.
 
All signage shall conform to the Columbus City Code as it applies to the C-3, Commercial District.  Any variance to the sign requirements shall be submitted to the Columbus Graphics Commission.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
