Explanation
1. BACKGROUND
The City of Columbus, Department of Public Service was engaged in the Arterial Street Rehabilitation - Parsons-Livingston Avenue project. This project consisted of the addition of or reconstruction of 1.3 miles of a 5 foot to 10 foot wide sidewalk on the North and South side of Livingston Avenue and 0.5 miles of a 7 foot to 8 foot wide sidewalk on the East and West side of Parsons Avenue. 117 ADA ramps were added or reconstructed also. At the time contract legislation was written, there were 14 bus stops and transit routes within the limits of this project. Related engineering work, consultant services, and creation of record plan drawings were done prior to the above improvements.
A portion of real property owned by the City of Columbus known as 732 East Livingston Avenue (Livingston Park), Franklin County Parcel Numbers 010-066806-00, needs to be converted to and dedicated as right-of-way for roadway purpose to accommodate the above improvements by this project. Current plans indicate a 0.131 acre will need to be converted and dedicated for this purpose, to dedicate the property as road right-of-way and name the road right-of-way as East Livingston Avenue.
This ordinance permits the City to convert and dedicate the property as road right-of-way and name the road right-of-way as East Livingston Avenue.
2. FISCAL IMPACT
There is no expenditure associated with this Ordinance.

WHEREAS, Ohio Revised Code Chapter 723.03 requires property to be used as a public street or alley be accepted and dedicated as public right-of-way by an ordinance specially passed for such purpose; and
WHEREAS, current plans indicate City owned land, totaling 0.131 acre tract, will need to be converted and dedicated to right-of-way for this purpose; and
WHEREAS, the City desires to convert and dedicate a 0.131 acre tract, as public right-of-way; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City of Columbus hereby dedicates the following described property as road right-of-way; to-wit:

Situated in the State of Ohio, County of Franklin, City of Columbus, lying in Section 15, Township 5, Range 22, Refugee Lands, being part of the tract conveyed to City of Columbus by deed of record in Deed Book 20, Page 212, part of Parcel 1 as shown on that plat entitled "Children's Hospital Urban Renewal Area, Plat A" of record in Plat Book 43, Page 17 conveyed to City of Columbus by deeds of record in Deed Book 2573, Page 666, Deed Book 2549, Page 10, and Deed Book 2542, Page 207, and a portion of Monroe Avenue [formerly Pendleton Avenue (name change Ordinance Number 31677)] vacated by City of Columbus Ordinance Number 1493-66, (all references are to the records of the Recorder's Office, Franklin County, Ohio) and being more particularly described as follows:
BEGINNING in the northerly right-of-way line of Livingston Avenue (Plat Book 2, Page 2), at the southwesterly comer of said Parcel 1, being a southeasterly comer of the 2.715 acre tract conveyed to Nationwide Children's Hospital by deed of record in Instrument Number 200712310221603;
Thence with the easterly line of said 2.715 acre tract and the westerly line of said Parcel 1, the following courses:
with a curve to the right, having a central angle of 90° 04' 36", a radius of 20.00 feet, an arc length of 31.44 feet, and a chord which bears North 23° 54' 27" West, a chord distance of 28.30 feet, to an iron pin set;
North 21 ° 07' 51" East, a distance of 16.14 feet, to an iron pin set;
with a curve to the left, having a central angle of 01 ° 55' 1 0", a radius of 666.62 feet, an arc length of 22.33 feet, and a chord which bears North 20° 10' 16" East, a chord distance of 22.33 feet, to an iron pin set;
Thence across said City of Columbus tract, the following courses and distances: South 70° 36' 11" East, a distance of 3.84 feet, to an iron pin set;
South 22° 11' 06" East, a distance of70.16 feet, to an iron pin set;
South 68° 56' 45" East, a distance of 434.92 feet, to an iron pin set;
with a curve to the right, having a central angle of 05° 43' 45", a radius of 1501.50 feet, an arc length of 150.14 feet, and a chord which bears South 66° 04' 53" East, a chord distance of 150.07 feet, to an iron pin set in said northerly right-of-way line;
Thence North 68° 56' 45" West, a distance of 616.38 feet, with said northerly right-of-
way line, to the POINT OF BEGINNING, containing 0.131 acre (5722.09 s.f.), more or less.
Subject, however, to all legal rights-of-way and/or easements, if any, of previous record.
Iron pins set, where indicated, are iron pipes, thirteen sixteenths (13/16) inch inside diameter, thirty (30) inches long with a plastic plug placed in the top bearing the initials EMHT INC.
The bearings herein are based on the Ohio State Plane Coordinate System, South Zone, per NAD83 (1986 adjustment). Control for bearings was from coordinates of monuments Frank 43 & Frank 143, having a bearing of Sout 87° 56' 16" East, established by the Franklin County Engineering Department.
