Explanation

1. Background

The City of Columbus, Department of Public Service, received a request from Husam Abu-Obeid, asking that the City transfer them a 960 square foot (0.022 acre) portion of the right-of-way near 1485 Sunbury Rd.  The right-of-way area is north of Holt Avenue and west of Sunbury Road. Right-of-way area runs north/south for approximately 145 +/- feet, and is 10+/- feet in width. Abutted by parcel 010-167441. The right-of-way is currently known as Sunbury Road.

 

Transfer of this right-of-way will allow room for maneuverability with plans to open a grocery/convenience store on the existing property. The Department of Public Service has agreed to sell the right-of-way via a quitclaim deed as described and shown within attached legal description and exhibit, and extinguishes its need for this public right-of-way. 

 

Per current practice, comments were solicited from interested parties, including City agencies, private utilities, and the applicable area commission, before it was determined that, subject to the retention of a general utility easement for those utilities currently located within this right-of-way, the City will not be adversely affected by the transfer of this right-of-way. 

 

The Department of Public Service submitted a request to the City Attorney’s Office, asking that they establish a value for this right-of-way, and a value of $4,290.00 was established. 

 

This request went before the Land Review Commission on October 16, 2025.  After review of the request, the Land Review Commission voted to recommend the above referenced right-of-way be transferred to Husam Abu-Obeid at the reduced cost of $1,916.00 to him.

                     

2. FISCAL IMPACT

The City will receive a total of $1,916.00, and the funds are to be deposited in Fund 7748, Project P537650, as consideration for the transfer of the requested right-of-way.

Body

WHEREAS, it has become necessary in the usual daily operation of the Department of Public Service to authorize the Director to execute the documents necessary to extinguish its need for this right-of-way and sell the land to Husam Abu-Obeid; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.    That the Director of the Department of Public Service be, and hereby is, authorized to execute a quitclaim deed and other incidental instruments prepared by the City Attorney’s Office, necessary to transfer the right-of-way described below and depicted in the attached exhibit which is incorporated into this ordinance for reference, to Husam Abu-Obeid; to-wit:

DESCRIPTION OF A 0.022 ACRE  TRACT

 

Situated in the City of Columbus, County of Franklin, State of Ohio, Quarter Township 3, Township 1, Range 17, United States Military Lands, being a 0.022 acre portion of Sunbury Road right-of-way (maintained by the City of Columbus), as dedicated in Amvets Homestead Subdivision Number 1, of record in Plat Book 21, Page 47; said 0.022  acres being more particularly described as:

 

Commencing, for reference, at a ½ inch iron pipe found (0.3’ below surface) at the northeast corner of Lot 3 in Amvets Homestead Subdivision Number 1 Replat (of Lot 14, Block C), of record in Plat Book 23, Page 27, the same being the northwest corner of  (remainder of) Lot 14 in said replat, as conveyed to Husam Abu-Obeid in I.N. 201802090018877 and being in the southerly right-of-way line of Argyle Drive (60’, P.B. 21, Page 47); thence, South 67° 23’ 51” East, with a northerly line of said Lot 14 and said southerly right-of-way, a distance of 80.35 feet to a rebar set at a point of curvature; thence, with a northerly line of said Lot 14 and with said right-of-way line, with the arc of a curve to the right, having a radius of 19.61 feet, a delta angle of 90° 08’ 35”, an arc length of 30.85 feet and a chord that bears South 22° 20’ 19” East, a chord distance of 27.77 feet to a rebar set at a northerly corner of said Lot 14, the same being in the westerly right-of-way line of Sunbury Road (P.B. 21, Pg. 47, right-of-way varies) and being the TRUE PLACE OF BEGINNING.

 

Thence, from said TRUE PLACE OF BEGINNING, South 15° 04’ 31” West, crossing into a right-of-way area of said Sunbury Road, a distance of 110.17 feet to a rebar set;

 

Thence, South 54° 29’ 17” West, crossing into a right-of-way area of said Sunbury Road, a distance of 15.45 feet to a rebar set;

 

Thence, North 86° 05’ 56” West, crossing into a right-of-way area of said Sunbury Road, a distance of 6.88 feet to a rebar set at the intersection of said westerly right-of-way (Sunbury Road) with the northerly right-of-way line of Holt Avenue (66’, P.B. 21, Page 47), said rebar also being the southeasterly corner of said Lot 14;

 

Thence, North 22° 43’ 04” East, with the easterly line of said Lot 14 and with the westerly line of said Sunbury Road right-of-way, a distance of 124.55 feet to the TRUE PLACE OF BEGINNING.

Containing 0.022 acres of land. Being out of Sunbury Road right-of-way (maintained by the City of Columbus).

This legal description is based upon an actual field survey, performed by and under the direct supervision of William D. Beer, P.S. #7980 in September and October of 2025.

Said Survey of this description is attached hereto and made part thereof. Subject to all easements, restrictions, and rights-of-way of record.

All rebars set are 5/8 inch, 30 inches long (w/ “B.L. SURVEYING, P.S. #7980” cap).

 

Bearings are based on North 22°43’04” East, as derived from GPS observations for the westerly right-of-way line of Sunbury Road (R/W varies), utilizing ODOT RTN and being based on Ohio State Plane Coordinate System (South Zone), NAD ’83, with a 2011 NSRS adjustment, Epoch 2010.

All deed references are to records of the Recorder’s Office, Franklin County, Ohio.

 

 

Section 2.    That the attached referenced real property shall be, and hereby is, considered excess road right-of-way and the public rights therein shall terminate upon the Director's execution and delivery of said quitclaim deed to the grantee thereof.

 

Section 3.    That a general utility easement in, on, over, across and through the legal description and attached exhibit describing the right-of-way shall be retained unto the City of Columbus for those utilities located within said right-of-way.

 

Section 4.    That upon notification and verification of the relocation of all utilities located within the retained general utility easement area the Director of the Department of Public Service is hereby authorized to execute those documents necessary to release the retained general utility easement with no additional compensation due to the City and with no further legislative action required by the City.

 

SECTION 5.  That the $1,916.00 to be received by the City as consideration for the sale of these rights-of-way shall be deposited in Fund 7748, Project P537650.

 

Section 6.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
