Explanation

 

Ordinance 2078-2003, passed September 29, 2003, authorized the acceptance of a plats titled THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 1 and THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 2 from COLUMBUS LAND INVESTMENT COMPANY and CROSSMANN COMMUNITIES OF OHIO, INC  Subsequently this property was transferred to BEAZER HOMES INVESTMENTS, LLC.  The Department of Public Service, Transportation Division is now requesting that Ordinance 2078-2003 be repealed and to accept the plats also titled THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 1 and THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 2 from BEAZER HOMES INVESTMENTS, LLC, a Delaware limited liability company, by MARK HOSTETTLER, Vice President of Finance.

 

Title

 

To repeal Ordinance 2078-2003 and to accept the plats titled THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 1 and THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 2 from BEAZER HOMES INVESTMENTS, LLC, a Delaware limited liability company, by MARK HOSTETTLER, Vice President of Finance; and to declare an emergency.

WHEREAS,                     Ordinance 2078-2003, passed September 29, 2003, authorized the acceptance of a plat titled THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 1 and THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 2 from COLUMBUS LAND INVESTMENT COMPANY and CROSSMANN COMMUNITIES OF OHIO, INC.; and

 

WHEREAS,                     subsequently this property was transferred to BEAZER HOMES INVESTMENTS, LLC, a Delaware limited liability company; and

 

WHEREAS,                     the Department of Public Service, Transportation Division is requesting that Ordinance 2078-2003, passed September 29, 2003, be repealed to facilitate the acceptance of the replacement plats also titled THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 1 and THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 2; and

 

WHEREAS, BEAZER HOMES INVESTMENTS, LLC, a Delaware limited liability company, by MARK HOSTETTLER, Vice President of Finance, owner of the platted lands, desires to dedicate to the public use all or such parts of the Avenue and Drives shown on said plat and not heretofore so dedicated and  now, therefore

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service and Transportation in that it is immediately necessary to pass this ordinance as an emergency measure because of the need to expedite the sale of the lots and allow for the submittal of building permits for new home construction during construction of the infrastructure; for the preservation of the public health, peace, property, safety, and welfare; now therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.                     That Ordinance 2078-2003, passed September 29, 2003, which authorized the acceptance of the plats titled THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 1 and THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 2 from COLUMBUS LAND INVESTMENT COMPANY and CROSSMANN COMMUNITIES OF OHIO, INC. be and hereby is repealed.

 

Section 2.                     That the plats titled THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 1 and THE VILLAGE AT ABBIE TRAILS SECTION 2 PART 2 from BEAZER HOMES INVESTMENTS, LLC, a Delaware limited liability company, by MARK HOSTETTLER, Vice President of Finance, on file in the office of the City Engineer, Transportation Division, be and the same is hereby accepted.

 

Section 3.                     That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
