Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Utilities to modify the construction contract with Kokosing Construction Company, Inc. for the Southerly Wastewater Treatment Plant New Headworks Project. The modification amount requested under this ordinance is $495,000.00; the contract total including this modification will be $46,442,099.00.
This contract modification will provide for the payment of work associated with the temporary modifications to the plant's 15,000 Volt overhead electrical distribution grid, and to provide steel friction piles needed to be installed by a later contract in the current program, as recommended by the City's Professional Program Manager (PPM) for the 2006-2010 Plants Wet Weather CIP program.
The Wet Weather Management Plan (WWMP), which the City developed in compliance with the City's Consent Decree with the State of Ohio, includes the requirement that the effluent pumping facilities and secondary clarifiers at the Southerly plant be extensively upgraded. This upgrade work is currently being designed, and will be bid separately in 2007. To assure the success of that upgrade project, the design engineer and the PPM have recommended to the City that this additional work be immediately added to the S67 contract, which is currently under construction, in order to allow the two following contracts to begin work as soon as they are bid, award is recommended, loan assistance is obtained, the contracts are authorized, and the contracts are fully-executed. The PPM has recommended that the only practical way to meet the City's general project schedule commitments to EPA is to immediately undertake these work items as a part of the work of an existing construction contract at the Southerly plant.

3. FISCAL IMPACT:
This ordinance authorizes the transfer and appropriation of funds from the Sanitary Sewer Reserve Fund for this expenditure. The 2007 Capital Improvements Budget is amended for this expenditure upon passage of this ordinance. Monies for this modification are provided from a proposed Fall 2007 Bond Sale via the transfer detailed in this ordinance.

WHEREAS, Contract No. EL005302 was authorized by Ordinance No.0200-2005, passed by Columbus City Council on March 28, 2005 for purposes of authorizing the Director of Public Utilities to enter into a construction contract with Kokosing Construction Company, Inc. for the Southerly Wastewater Treatment Plant New Headworks Project; and
WHEREAS, it is now necessary to modify this contract to provide for the execution of needed additional work; and
WHEREAS, it is necessary to transfer and appropriate funds from the Sanitary Sewer Reserve Fund to the Voted Sanitary Sewer Bond Fund for this project expenditure; and
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and
WHEREAS, it is immediately necessary to authorize the Director of Public Utilities to modify the construction contract for the Southerly Wastewater Treatment Plant New Headworks Project, in order to add certain work now deemed necessary to the timely completion of the Division's Wet Weather Management Plan infrastructure improvements within the schedule commitments made to Ohio EPA, for the immediate preservation of the public health, peace, property, and safety; Now, Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. EL005302 with Kokosing Construction Company, Inc., 886 McKinley Avenue, Columbus, Ohio 43222 for construction of the for the Southerly Wastewater Treatment Plant New Headworks Project in order to provide for additional work in accordance with the terms and conditions as shown in the Modification on file in the office of the Division of Sewerage and Drainage.
Section 2. That from the unappropriated monies in the Sanitary Sewer Reserve Fund No. 654, and from all monies estimated to come into said fund from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2007, the sum of $495,000.00 is hereby appropriated to the Division of Sewerage and Drainage: Division 60-05| OCA Code 901654 | Object Level One 10| Object Level Three 5502.
Section 3. That the City Auditor is hereby authorized to transfer $495,000.00 to the Voted Sanitary Sewer Bond Fund 664, into the Southerly Wastewater Treatment Plant New Headworks Project, Project No. 650352, at such time as deemed necessary by the Auditor, and to expend said funds, or so much thereof as may be necessary.
Section 4. That the $495,000.00 is hereby appropriated for the Southerly Wastewater Treatment Plant New Headworks Project, within the Voted Sanitary Sewer Bond Fund| Fund 664| Division 60-05| Project 650352| OCA Code 650352| Object Level Three 6624.
Section 5. That upon obtaining other funds for the purpose of funding sanitary sewer system capital improvement work, the City Auditor is hereby authorized to repay the Sewer System Reserve Fund the amount transferred above, and said funds are hereby deemed appropriated for such purposes.
Section 6. That the said construction company shall conduct the work to the satisfaction of the Director of Public Utilities, the Administrator of the Division of Sewerage and Drainage.
Section 7. That the expenditure of $495,000.00, or as much thereof as may be needed, is hereby authorized from the Voted Sanitary Sewer Bond Fund No. 664| Division 60-05| Project 650352| OCA Code 650352 | Object Level Three 6624.
Section 8. That the 2007 Capital Improvements Budget Ordinance No. 0733-2007 is hereby amended as follows, to provide sufficient budget authority for the execution of this modificaiton to a construction contract, and to amend as stated herein:

Section 9. That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
Section 10. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
Section 11. That this ordinance shall take effect and be in force from and after the earliest date allowed by law.
