Explanation
 
BACKGROUND:Need. This legislation authorizes the Director of Public Utilities to enter into an agreement with Evans, Mechwart, Hambleton & Tilton for professional engineering services for the Pilot Wetlands Mitigation  Project.  The Department of Public Utilities has a need for a wetland mitigation project due to impact to existing wetlands on some currently on-going, and, potentially future projects.  This is a joint project with the Division of Water and the Sanitary Section of the Division of Sewerage and Drainage.
 
This legislation authorizes the transfer of monies with the 1991 Voted Sanitary Bond Fund, Fund 664, in order to provide the necessary funds. It also amends the 2002 Capital Improvements Budget.
 
Bid Information. The selection of the firm providing the professional engineering services has been performed in accordance with the procedures set forth in Columbus City Code, Section 329.12, "Awarding professional service contracts through requests for proposals." A notice of Request for Proposals appeared in the City Bulletin on March 15 and 22, 2003.  Proposals were received on March 26, 2003.  Seven consultants submitted Proposals.
 
Upon review of the technical proposals, the offerors have been ranked using criteria specified in City Code, and other criteria, specifically: competence to perform the required service, experience of Subconsultants' personnel, the feasibility/quality of the technical proposal, project schedule, evaluation of additions/deletions to basic Scope of Services, ability to perform expeditiously, availability of personnel, cost evaluation, past performance of the offeror, evaluation of tasks/activities and hours, work to be performed in Franklin County, and contracted backlog of work with Stormwater Management Section.
 
Based upon these criteria, Evans, Mechwart, Hambleton & Tilton was selected as the highest ranked offeror.
 
Emergency Designation:  This ordinance is submitted as an emergency so as to allow the financial transaction to be posted in the City's accounting system as soon as possible.  Up to date financial posting promotes accurate accounting and financial management.

FISCAL IMPACT:  Budgeted Amount: There are funds and sufficient spending authority available for this expenditure pending passage of a transfer/CIB amendment ordinance (STORMWMAH18-2003-03).
 
There will be sufficient funds in the appropriate sanitary project account, upon passage of this ordinance.  There will be sufficient authority in the 2002 Capital Improvements Budget for this expenditure, upon passage of this ordinance.

Body
 
WHEREAS, it is necessary to mitigate the impact to existing wetlands which will occur on some on-going (and, potentially, future) Department's projects; and
 
WHEREAS, it is necessary to authorize the Director of Public Utilities to enter into an agreement for professional engineering services to mitigate the impact to existing wetlands; and
 
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer from the available balances within the 1991 Voted Sanitary Bond Fund, in order to fund this agreement; and
 
WHEREAS, it is immediately necessary to amend the 2002 Capital Improvements Budget to provide sufficient authority for increasing a capital project account; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, in that it is immediately necessary to enter into this engineering agreement and to transfer funds within the 1991 Voted Sanitary Bond Fund, so as to efficiently use existing available balances in order to execute the aforementioned agreement, for the preservation of the public health, peace, property and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Director of Public Utilities be, and hereby is, authorized to execute an agreement with Evans, Mechwart, Hambleton & Tilton, 170 Mill Street, Gahanna, Ohio 43230-3036 for the Division of Sewerage and Drainage, for professional engineering services in accordance with the terms and conditions on file in the office of the Division of Sewerage and Drainage.
 
Section 2. That the said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
 
Section 3.  That the City Auditor is hereby authorized and directed to transfer a total of $80,000.00 with the said fund as follows:
 
Division of Sewerage and Drainage, Division 60-05
Fund 664, 1991 Voted Sanitary Bond Fund
 
From:  Project 650370, Maintenance Management Plan Upgrade - $80,000.00
To:  Project 650352, SWWTP New Headworks - $80,000.00
 
Section 4.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
 
Section 5.  That the 2002 Capital Improvements Budget Ordinance No. 1674-02 is hereby amended and increased as follows, to provide sufficient budget authority for the execution of the agreement stated in Section 1.

Section 6. That for the purpose of paying the cost of the professional engineering services contract, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows:  Division 60-05, Fund 664, Project 650352, Object Level Three 6682, OCA Code 650352, Amount $80,000.00; Division 60-15, Fund 685, Project 610753, Object Level Three 6682, OCA Code 685753, Amount $15,000.00; Division 60-09, Fund 606, Project 690265, Object Level Three 6682, OCA Code 690265, Amount $10,000.00.
 
Section 7. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
