Explanation
Background: The City owns real property located at 760 Alum Creek Drive, Columbus, Ohio 43205, commonly known as Schneider Park {Franklin County Tax Parcel 010-216817}. This ordinance authorizes the Director of Development (Development), with the approval of the Director of Recreation and Parks Department (CRPD), to grant a 0.223 acre permanent easement and a 0.146 acre temporary easement to the City of Bexley in order for the City of Bexley to construct and maintain, at its sole cost and expense, a public pedestrian bridge over Alum Creek connecting both cities’ portions of the Alum Creek Trail.
Development and CRPD support waiving any compensation for the easements in the interest of inter-governmental cooperation and the fact it is a public improvement project.

WHEREAS, it is necessary to authorize the Director of Development, (Development) with the approval of the Director of Recreation and Parks Department (CRPD) to grant a 0.223 acre permanent easement and a 0.146 acre temporary easement to the City of Bexley in order for the City of Bexley to construct a public pedestrian bridge, at Bexley’s sole expense, over Alum Creek; and
WHEREAS, the City of Bexley will maintain the bridge once completed; and
WHEREAS, Development and CRPD support waiving compensation for the easements in the interest of inter-governmental cooperation and the fact it is a public improvement project; and
WHEREAS, it has become necessary in the usual daily operation to grant this easement for the construction of a new pedestrian bridge for the immediate preservation of the public health, peace, property, safety, and welfare; and NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Development, with the approval of the Director of Recreation and Parks, be, and hereby is, authorized to execute and acknowledge any document(s) necessary to quitclaim grant to the City of Bexley a 0.146 acre temporary easement and a 0.223 permanent easement to burden a portion of the City’s real property located at 760 Alum Creek Drive, Columbus, Ohio 43205, {Franklin County Tax Parcel 010-216817}, in order for the City of Bexley to construct and maintain, at the City of Bexley’s sole cost and expense, a public pedestrian bridge over Alum Creek spanning into the Alum Creek riparian parkland. The easements are described and depicted in the five (5) page attachment, which is fully incorporated for reference as if rewritten.
SECTION 2. That the Department of Law, Real Estate Division is required to preapprove all document(s) executed by the City pursuant to this ordinance.
SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
