Explanation
BACKGROUND: Columbus Public Health provides tuberculosis testing for patients of its TB Clinic. The laboratory of Columbus Public Health uses QuantiFERON - TB GOLD test kits. It is the only in vitro test for mycobacterium tuberculosis (TB) infection approved for use by the US FDA. Its use is recommended by the CDC. Cellistis, Inc. is the sole manufacturer/distributor of these test kits.
Emergency action is requested to ensure a sufficient supply of test kits for testing of patients. Cellestis, Inc.'s contract compliance number is 522310821.
FISCAL IMPACT: Funding for this purchase is budgeted in the 2012 Health Department Grants Fund.

To authorize the Director of Finance and Management to establish a purchase order with Cellestis, Inc. for the purchase of QuantiFERON - TB GOLD kits for Columbus Public Health in accordance with sole source provisions of the Columbus City Codes; to authorize the expenditure of $3,000.00 from the Health Department Grants Fund; and to declare an emergency. WHEREAS, Columbus Public Health provides TB testing for patients of the TB Clinic in the City of Columbus; and,
WHEREAS, Columbus Public Health is in need of QuantiFERON - TB GOLD test kits to provide the testing; and,
WHEREAS, Cellestis, Inc. is the sole supplier of QuantiFERON - TB GOLD test kits; and,
WHEREAS, an emergency exists in the usual daily operation of Columbus Public Health in that it is immediately necessary to enter into a contract with Cellestis, Inc. for the immediate preservation of the public health, peace, property, safety and welfare, and to ensure a sufficient supply of test kits for testing of patients; Now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Finance and Management is hereby authorized to establish a purchase order with Cellestis, Inc. for the purchase of QuantiFERON - TB GOLD test kits.
SECTION 2. That the total expenditure of $3,000.00 is hereby authorized from the Health Department Grants Fund, Fund No. 251, Department of Health, Department No. 50, Object Level One 02, Object Level Three 2293, Grant No. 507104, OCA Code 507104.
SECTION 3. That this purchase is in accordance with the provisions of the Columbus City Code, Section 329.07(e), "Sole Source Procurement."
SECTION 4. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
