Explanation
 
BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a contract to install a street lighting system using wood poles and overhead lines for the Leawood Gardens and Willis Park Area.  This legislation also authorizes a transfer of funds within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund and an amendment to the 2002 Capital Improvements Budget.
 
The bid opening was advertised in the City Bulletin and three bids were received and opened by the Director of Public Utilities on June 11, 2003.  Two bids were from majority business enterprises and one was from a certified emerging female business enterprise, U.S. Utility Contractor Co., Inc.   The bids received were as follows:

The bids have been evaluated and an award is recommended to U.S. Utility Contractor Co., Inc. as the lowest responsive bid.
 
In addition, approval is requested for the expenditure of $30,185.00 to pay the estimated construction inspection costs to the Transportation Division.
 
Emergency action is requested in order that the contract may be executed and construction may be completed during the 2003 construction season.
 
FISCAL IMPACT:  There is sufficient funding in the Voted 1995 and 1999 Street Lighting and Electricity Distribution System Improvements Fund.  This legislation authorizes the transfer and the expenditure of funds.

Body
 
WHEREAS, bids were received and opened by the Director of Public Utilities on June 11, 2003 to install a street lighting system using wood poles and overhead lines in the Leawood Gardens and Willis Park area; and
 
WHEREAS, U.S. Utility Contractor Co., Inc. submitted the lowest responsive bid for the installation of said street lighting improvements; and
 
WHEREAS, it is necessary to transfer $307,522.97 within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund and to expend same; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Electricity, in that it is immediately necessary to enter into a contact to install street lighting in the Leawood Gardens and Willis Park area for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities is hereby authorized to enter into a contract with U.S. Utility Contractor Company, Inc., in the amount of $277,337.97, and to obtain and pay for the services of the Transportation Division for construction inspection services as may be required for the installation of street lighting improvements in the Leawood Gardens and Willis Park Area.
 
SECTION 2.  That Section 1 of the 2002 Capital Improvements Budget Ordinance No. 1674-02 is hereby amended as follows in order to provide sufficient budget authority for the installation of street lighting improvements in the Leawood Gardens and Willis Park Area:

SECTION 3.  That the City Auditor is hereby authorized to transfer $307,522.97 within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund 553, Division No. 60-07, from Project No. 670977, Facilities Renovations, OCA 670977, Object Level Three 6621 to Project No. 670614, Leawod Gardens and Willis Park Street Lighting, OCA 670614, Object Level Three 6625.
 
SECTION 4.  That to pay the cost of the aforesaid contract and expenses, the expenditure of $307,522.97, or so much thereof as may be needed, be and is hereby authorized from Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund 553, Division No. 60-07, Project 670614, OCA 670614, Object Level Three 6625.
 
SECTION 5.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
