Rezoning Application Z24-058

 

APPLICANT:  Dream Living LLC; c/o Brenda Parker, Agent; 405 North Front Street; Columbus, OH 43215.

 

PROPOSED USE:  Residential development.

 

DEVELOPMENT COMMISSION RECOMMENDATION: Approval (5-0) on April 10, 2025.

 

COLUMBUS SOUTH SIDE AREA COMMISSION RECOMMENDATION: Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The 0.10± acre site consists of one undeveloped parcel in the L-C-2, Limited Commercial District. The requested AR-1, Apartment Residential District will allow up to a four-unit dwelling at this location. The site is located within the planning area of the Near Southside Plan (2011), which recommends “Mixed Use (Neighborhood)” land uses at this location. A concurrent Council variance (Ordinance #1370-2025; CV24-141) has been filed for a proposed two-unit dwelling with reduced lot width and side yard. Staff support the proposed district as it will allow uses consistent with the Plan’s land use recommendation. Additionally, the requested AR-1 district will match the existing zoning and development pattern to the west of the site and along this block of East Whittier Street. The proposed residential use is consistent with the existing uses in the surrounding area, and does not introduce and incompatible use to the neighborhood.

WHEREAS, application #Z24-058 is on file with the Department of Building and Zoning Services requesting rezoning of 0.10± acres from L-C-2, Limited Commercial District, to AR-1, Apartment Residential District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the Columbus South Side Area Commission recommends approval of said zoning change; and

 

WHEREAS, the City Departments recommend approval of said zoning change because the requested AR-1, Apartment Residential District will match the existing zoning and development pattern to the west, is consistent with the residential character of the surrounding neighborhood, and does not introduce an incompatible use to the area; now, therefore:

                     

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

 

1207 E. WHITTIER ST. (43206), being 0.10± acres located on the south side of East Whittier Street, 100± feet west of Lockbourne Road, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin, and the City of Columbus.

Being Lot Number Three Hundred Thirty (330) of JACOB H. STUDER’S SUBDIVISION, in said City being part of Half Section 31, Township 5, Range 22, Refugee Lands, as the same is numbered and delineated upon the recorded plat thereof, of record in Plat Book 5, pages 294 and 295, Recorder’s Office, Franklin County, Ohio.

SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the AR-1, Apartment Residential District on this property.

 

SECTION 3.  That the Director of the Department of Building and Zoning Services be, and is hereby authorized and directed to make the said changes on the said official zoning map in the office of the Department of Building and Zoning Services.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
