Explanation

 

BACKGROUND:  This legislation authorizes the Finance and Management Director to modify an existing Universal Term Contract (UTC) for the option to obtain Sievers TOC Analyzer Parts and Services with General Electric Analytical Instruments (GEAI).  This contract provides for parts and services needed for instruments used by the Division of Water in the Quality Assurance Laboratory.  This modification is necessary to change the company name on the contract established with General Electric Analytical Instruments (GEAI), due to a recent acquisition.  This ordinance authorizes the assignment of all past, present and future business done by the City of Columbus from General Electric Analytical Instruments (GEAI) to SUEZ WTS Analytical Instruments, Inc.  The contract, PO007232 was established in accordance with Solicitation No. SA005997  and will expire  March 30, 2018.

 

EMERGENCY DESIGNATION:  The Finance and Management Department respectfully requests this legislation  be considered an emergency to ensure that parts and services may be immediately available for instruments used in the Water Quality Assurance Laboratory.

 

FISCAL IMPACT: No funding is required to modify the option contract.  The Department of Public Utilities must set aside their own funding for their estimated expenditures.

To authorize the Finance and Management Director to modify the contract for the option to purchase Sievers TOC Analyzer Parts and Services with General Electric Analytical Instruments (GEAI) to change the company name to SUEZ WTS Analytical Instruments, Inc.; and to declare an emergency.

 

Body

 

WHEREAS, the Purchasing Office entered into a Universal Term Contract for Sievers TOC Analyzer Parts and Services for use by the Division of Water; and, 

 

WHEREAS, it is necessary to modify the existing Universal Term Contract with General Electric Analytical Instruments (GEAI),  as they have re-organized, taken a new name, and in addition to notifying the City of their organization SUEZ WTS Analytical Instruments, Inc.,  has agreed to honor the past, present and future contracts and agreements; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities in that it is immediately necessary to authorize the Finance and Management Director to modify a Universal Term Contract with  General Electric Analytical Instruments (GEAI) to change the company name to SUEZ WTS Analytical Instruments, Inc. for the option to obtain Sievers TOC Analyzer Parts and Services thereby preserving the public health, peace, property, safety, and welfare; now , therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Finance and Management Director is hereby authorized  to modify contract PO007232 for the option to obtain Sievers TOC Analyzer Parts and Services and assign all past, present and future purchase orders pursuant to that contract to reflect the change of the company name from General Electric Analytical Instruments (GEAI) to SUEZ WTS Analytical Instruments, Inc.

 

SECTION 2. That this modification is in accordance with relevant provisions of Chapter 329 of the Columbus City Code. 

 

SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
