Explanation
 
The Department of Recreation and Parks, acting on behalf of the City of Columbus ("City"), is engaged in the FRA-Goodale/Olentangy Trail Project.  The following is an ordinance to authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, and to expend the monies for payment of acquisition costs in connection with the FRA-Goodale/Olentangy Trail Project.
 
Fiscal Impact:  The Department of Recreation and Parks, has determined funding for this project will be from the Recreation and Parks Voted Bond Fund.
 
Emergency Justification: Emergency action is requested to allow acquisition activities to begin as soon as possible as not to delay the Department of Recreation and Parks project schedule, thereby preserving public health, peace, property and safety.

To authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, and to expend $6,500.00 from the Recreation and Parks Voted Bond Fund for costs relative to the acquisition of real property necessary to the FRA-Goodale/Olentangy Trail Project; and to declare an emergency. ($6,500.00)

WHEREAS, The Department of Recreation and Parks, acting on behalf of the City of Columbus ("City"), is engaged in the FRA-Goodale/Olentangy Trail Project; and
WHEREAS, it is necessary to expend $6,500.00 from the Recreation and Parks Voted Bond Fund for costs relative to the acquisition of certain real property necessary to the FRA-Goodale/Olentangy Trail Project; and
WHEREAS, an emergency exists in the usual daily operation of the City, in that it is immediately necessary to authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, and to expend the monies for payment of acquisition costs necessary to the FRA-Goodale/Olentangy Trail Project for the immediate preservation of the public health, peace, property and safety; NOW, THERFORE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1.      That the City Attorney be and is hereby authorized to acquire fee simple title and lesser interests in and to certain real property, and to contract for professional services, necessary to the FRA-Goodale/Olentangy Trail Project.
 
Section 2.      That the City Attorney be and is hereby authorized to expend $6,500.00, or so much thereof as may be necessary, from the Recreation and Parks Voted Bond Fund, OCA: 644625; Fund #702; Object Level Three: 6601; Dept./Div. 51-01, Project No. 510316-10000 for costs relative to the acquisition of certain real property necessary to the FRA-Goodale/Olentangy Trail Project.
 
Section 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
