Title: To authorize the City Attorney's Office, Real Estate Division, to contract for professional services relative to the acquisition of those property rights needed for the Lockbourne Road Culvert Replacement Project; to authorize the City Attorney's Real Estate Division to negotiate with the property owners for acquisition of the rights-of-way necessary to complete this project; to authorize the expenditure of $20,000.00 or so much thereof as may be necessary from the 1995, 1999, 2004 Voted Streets and Highways Fund for acquisition related expenses; and to declare an emergency. Explanation
 
The City of Columbus, Public Service Department, Transportation Division, is engaged in that project identified as the Lockbourne Road Culvert Replacement Project.  The purpose of this project is to remove the existing box culvert crossing Lockbourne Road just north of State Route 104 and replace it with a 72" storm sewer conduit and a headwall at the west end of the proposed storm sewer.  This work requires ditch regrading along the west side of Lockbourne Road.  The City will need to acquire both permanent and temporary construction easements to complete this project as designed.  The following legislation establishes the funding required to complete the property acquisition needed for this project; authorizes the City Attorney to acquire these property rights on behalf of the City and authorizes the City Attorney to expend those funds necessary to complete the acquisitions.  Construction will begin as soon as the easements are obtained and will take approximately 90 days to complete.
 
Fiscal Impact: Acquisition related expenses including title services, appraisal services, City Attorney staff and land costs are estimated to be $20,000.00.  This project is budgeted in the 2006 Transportation Division Capital Improvements Budget in the 1995, 1999, 2004 Voted Streets and Highways Fund City Bridge Rehabilitation Project.  
 
Emergency Justification: The existing box culvert is deteriorated and construction of the new storm sewer must begin as soon as possible.  Right-of-way acquisition must be completed before construction can begin therefore, it is immediately necessary to fund the acquisition process and to authorize the City Attorney to begin acquisition related activities.

WHEREAS, the City of Columbus is engaged in that project identified as the Lockbourne Road Culvert Replacement Project; and
 
WHEREAS, the purpose of this project is to remove the badly deteriorated existing box culvert crossing Lockbourne Road just north of State Route 104 and replace it with a 72" storm sewer conduit and a headwall at the west end of the proposed storm sewer; and
 
WHEREAS, the City must acquire both permanent and temporary construction easements to complete this project as designed; and
 
WHEREAS, acquisition related expenses including title services, appraisal services, City Attorney staff and land costs are estimated to be $20,000.00; and
 
WHEREAS, the following legislation establishes acquisition funding, authorizes the City Attorney to acquire the rights-of-way needed for this project and authorizes the City Attorney to expend $20,000.00, or so much thereof as may be necessary for the acquisition of the property needed for this project; and
 
WHEREAS, funds are available in the 1995, 1999, 2004 Voted Streets and Highways Fund to pay for said acquisition related costs; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the City Attorney to expend the funds necessary to acquire those rights-of-way needed to accommodate replacement of the deteriorated box culvert crossing Lockbourne Road without delay so that construction of this project can begin immediately for the preservation of the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 2.  That the City Attorney be and is hereby authorized to acquire those rights-of-way needed for the Lockbourne Road Culvert Replacement Project and to expend those funds required to pay related acquisition costs.
 
SECTION 3.  That for the purpose of paying for said costs the City Attorney's Office, Real Estate Division is hereby authorized to expend $20,000.00, or so much thereof as may be necessary from the 1995, 1999, 2004 Voted Streets and Highways Fund as follows: Project 530301; Department/Division 59-09; Minor Object 6601; OCA Code 644385; Amount $20,000.00.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
