Explanation
The Public Service Department, Transportation Division, engaged the services of Barr Engineering, Incorporated, to design the North High Street - Flint Road to Delaware County Line project as authorized by Ordinance 2088-1996 passed by City Council December 17, 1996.  This project is being designed to widen North High Street between Flint Road and the Delaware County line and includes the installation of sidewalks, curb ramps and traffic signals. This design consultant was selected in accordance with provisions of City Code Chapter 329 dealing with professional service contracts.
 
This legislation authorizes the Public Service Director to modify and increase this contract by $44,817.00 to design a right turn lane from southbound High Street to westbound Lazelle Road and to add sidewalk and curb ramps along the west side of High Street.  This modification is an addition to the original scope of services but is a continuation of the existing work being performed and it would not be practical to contract with a different consultant.  It also recognizes a change in the vendor's name from Barr Engineering, Incorporated, to Barr and Prevost.
 
Barr and Prevost's contract compliance number is 31-1347309; this expires November 18, 2006.  We have negotiated new hourly rates for this modification because the current contract is nine (9) years old.  Costs have increased by approximately three percent (3%) per year for the past eight years.  The overhead rate and percentage of profit from the original contract were used because they are still valid.
 
Fiscal Impact:  The Transportation Division budgeted $46,228 in the 2005 Capital Improvements Budget for the design modification for the Flint Road to Delaware County Line project.  Actual funds will be available within the 1995, 1999 Voted Streets and Highways Fund in the Arterial Street Rehabilitation project as a result of the Fall 2005 bond sale.  The original contract amount was $209,840.00.  This ordinance authorizes a modification of $44,817.00.  The contract amount including all modifications is $349,474.00.
 
Emergency action is requested for immediate modification of the design contract to provide for the completion of the design work as soon as possible to maintain scheduled construction to enhance motorist and pedestrian safety.

Body
WHEREAS, Contract No. CT-17926 for design of the North High Street - Flint Road to Delaware County Line project was authorized by Ordinance 2088-1996 passed December 17, 1996, executed and approved by the City Attorney on January 13, 1997; and
 
WHEREAS, it is necessary to modify this contract to increase the scope of services per the consultant's letter dated April 25, 2005; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified and increased immediately to provide for completion of the design work as soon as possible to maintain scheduled construction to enhance motorist and pedestrian safety, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to assign all past, present and future City of Columbus business transactions with Barr Engineering, Incorporated, to Barr and Prevost.
 
SECTION 2.  That the Public Service Director be and hereby is authorized to modify and increase Contract No. CT-17926 with Barr and Prevost, 2800 Corporate Exchange Drive, Suite 240, Columbus, Ohio 43231 to complete the design and construction plans and obtain the necessary permits for the North High Street - Flint Road to Delaware County Line project in accordance with the plans on file in the office of the Public Service Director.
 
SECTION 3.  That for the purpose of paying the cost of said contract modification, the sum of $$44,817.00 or so much thereof as may be needed be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 530103.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
