Explanation
 
Background:
This ordinance will authorize the Director of Recreation and Parks to enter into an agreement with the Director of Transportation for the Ohio Department of Transportation for the construction of a bike path on new alignment from the intersection of Alum Creek Drive and Performance Way to the existing north terminus of the Alum Creek Trail east of Alum Creek and South of State Route 104.
 
This ordinance will also authorize the transfer of funds within the Parks and Recreation 1995 and 1999 Bond Fund and an expenditure for the local costs of this project.
 
Participation in this project was authorized by Ordinance No. 1087-02, Final Resolution, passed July 15, 2002 by Columbus City Council.
 
Emergency action is requested to allow this project to proceed in a timely manner.
 
Fiscal Impact:
$394,790.00 is budgeted in the Parks and Recreation 1995 and 1999 Voted Bond Fund to meet the financial obligation of this agreement.
 
$204,913.54 is being transferred within the Voted 1995 and 1999 Parks and Recreation Bond Fund, as shown in Section 2 of this ordinance.

To authorize the Director of Recreation and Parks to enter into an agreement with the Ohio Department of Transportation for a portion of the Alum Creek Bikeway, to authorize the transfer of $204,913.54  within the Parks and Recreation 1995 and 1999 Voted Bond Fund, to authorize an expenditure of $394,790.00, and to declare an emergency.  ($394,790.00)
 
 
Body
 
      WHEREAS, it is necessary for the Recreation and Parks Department to enter into an agreement with the Ohio Department of Transportation for the construction of a bike path on new alignment; and
 
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into this agreement, transfer and expend these funds to allow this project to proceed in a timely manner; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
      Section 1.   That the Director of Recreation and Parks be and he is authorized to enter into an agreement with the Director of Transportation, Ohio Department of Transportation, for the construction of the Alum Creek Bikeway on new alignment; and
 
      Section 2.   That the transfer of $204,913.54 within the Voted 1995 and 1999 Parks and Recreation Bond Fund be and is hereby authorized to provide funds in the proper project account for this project for the Recreation and Parks Department, as follows:

      Section 3.   That the expenditure of  $394,790.00, or so much thereof as may be necessary, be and is hereby authorized from the Voted 1995 and 1999 Parks and Recreation Bond Fund No. 702, Dept. 51-01, Project No.  510316, Greenways Project, OCA Code 644526, Object Level 3 6621, to pay the cost thereof.            
 
      Section 4.   That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
 
      Section 5.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
