The following resolution was approved at the February 18, 2025 Columbus Board of Health meeting.

To repeal Chapter 259 of the Columbus City Health Code titled Food Salvage.

WHEREAS, the Ohio Department of Agriculture performs all functions involved in wholesale food protection within the state; and,

WHEREAS, the Ohio Revised Code §3715.021(A) defines "food processing establishment" to include “the activities of a bakery, confectionery, cannery, bottler, warehouse, or distributor, and the activities of an entity that receives or salvages distressed food for sale or use as food.”; and,

WHEREAS, the Ohio Revised Code §3715.021(B) states: “The director of agriculture shall adopt rules in accordance with Chapter 119. of the Revised Code that establish, when otherwise not established by the Revised Code, standards and good manufacturing practices for food processing establishments, including the facilities of food processing establishments and their sanitation...”; and,

WHEREAS, the Ohio Revised Code §3715.041 details how the Director of Agriculture shall register, inspect, and enforce standards for food processing establishments; and,

WHEREAS, the Columbus City Health Code needs updated to repeal Chapter 259 as the food salvage processing plants and distributors are currently under regulation of the Ohio Department of Agriculture as food processing establishments, and update the Title Five heading; now therefore,
