BACKGROUND: The purposes of this ordinance are to amend Ordinance 1269-2001 in which the City and the Village of Obetz entered into an Economic Development Agreement and to allow the Director of Development to enter into a First Amendment to the Economic Development Agreement.
      
In Ordinance 1269-2001, the City and the Village agreed to income tax revenue sharing from individuals employed within certain parcels of annexed property for a period of 50 years. In an effort to foster regional cooperation in matters of economic development, the City and the Village seek to cooperate in the attraction and retaining of a new Whirlpool facility.  As such it is necessary to amend Ordinance 1269-2001 to clarify the jurisdiction and enforcement of municipal building and zoning regulations and the sharing of municipal income taxes until the City can effect a boundary adjustment pursuant to Ohio Revised Code Section 709.37 bringing the Whirlpool facility solely within the City of Columbus.
 
Emergency legislation is requested to allow the preliminary arts evaluation to be implemented and completed in a timely manner.
 
FISCAL IMPACT: No funding is required for this legislation.
 
 
Title
 
To authorize the Director of the Department of Development to enter into a First amendment of the economic development agreement to clarify the jurisdiction and enforcement of municipal building and zoning regulations and the sharing of municipal income taxes; and to declare an emergency.
 
 
Body
 
WHEREAS, in City Ordinance 1269-2001, the City and the Village entered into an economic development agreement for purposes of economic development; and
      
WHEREAS, as part of the agreement the City and the Village agreed to share income tax revenue from individuals employed within certain parcels of property; and
 
WHEREAS, due to the 50 year term of the agreement, mutually agreed to amendments as a result of changing economic development conditions or opportunities were provided for in section V of the agreement; and
 
WHEREAS, in an effort to foster regional cooperation in matters of economic development, the City and the Village seek to cooperate in attraction and retaining a new Whirlpool facility bringing substantial job creation and new investment; and
 
WHEREAS, the City and the Village of Obetz wish to enter into an agreement regarding the enforcement of municipal building and zoning regulations and the sharing of municipal income taxes until the City can effect a boundary adjustment pursuant to Ohio Revised Code Section 709.37 bringing the Whirlpool facility solely within the City of Columbus; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to enter into the amendment of the economic development agreement to address the aforementioned issues to facilitate the project moving forward until the parties are able to effect a boundary adjustment, thereby  preserving the public health, peace, property, safety and welfare; and, NOW, THEREFORE,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.  That the Director of the Department of Development is hereby authorized and directed to enter into the first amendment to the economic development agreement with the Village of Obetz for to clarify the jurisdiction and enforcement of municipal building and zoning regulations and the sharing of municipal income taxes.
 
Section 2. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves or vetoes the same.
