Title: To authorize and direct the Finance and Management Director to extend the current Memorandum of Understanding with The Ohio State University Hospitals to participate in contracts available through Novations Company. and to declare an emergency.
Explanation
 
BACKGROUND: The purpose of this legislation is to extend the authority of the Memorandum of Understanding (MOU) between The Ohio State University Hospitals and the City of Columbus to purchase through the Novations Company when it is considered prudent by the Finance & Management Director.  The initial agreement was for a three-year period which ends June 27, 2006 and allows for three 3-year extensions.
 
The MOU was established June 26, 2003 (Ordinance 1608-2003) with The Ohio State University Hospitals.  In the MOU, the City of Columbus was sponsored as an Alternate Purchasing Location and thereby allowed to access contracts competitively bid by Novations Company for the purchase of various supplies and pharmaceuticals required by the City to provide emergency services to the public. This MOU does not replace competitive bidding of such items but serves as an additional resource to be used as needed. This arrangement has been beneficial and is an important supply chain resource for the Division of Fire.
 
Pursuant to the terms of the MOU, this ordinance seeks permission to renew and extend the agreement for three 3-year periods after such time the agreement will terminate.
 
FISCAL IMPACT: The Division of Fire will be required to obtain approval to expend from their own appropriations when using this agreement.

WHEREAS, the City of Columbus and The Ohio State University established a Memorandum of Understanding (MOU) on June 26, 2003 (per Ordinance #1608-2003) to permit the City to purchase various supplies and pharmaceuticals used when providing emergency services to the citizens of Columbus through the Novations Company when needed; and
 
WHEREAS, this MOU permitted the extension of this agreement and the Finance and Management Director has determined that it is in the best interest of the City of Columbus to extend the MOU for three, 3-year periods;  now, therefore and
 
WHEREAS, an emergency exists in the usual daily operation of the Purchasing Office in that it is immediately necessary to extend this MOU with The Ohio State University thereby preserving the public health, peace, property, safety, and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That the Finance and Management Director be and is hereby authorized and directed to extend the authority of the Memorandum of Understanding (MOU) between the City of Columbus and The Ohio State University to participate in contracts available through Novations Company for three, 3-year periods, to and including June 26, 2015.
 
SECTION 2. That this Memorandum of Understanding will terminate on June 27, 2015.
 
SECTION 3. That for the reasons stated in the preamble here to, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
