Explanation
Background:  This ordinance modifies and increases an existing contract with Floyd Browne Associates, Incorporated (fka FBA Environmental) for landfill gas monitoring and mitigation services for the Refuse Collection Division.   The City of Columbus operated several sanitary landfills in the 1960s and 1970s.  Methane gas is generated from the decomposition of trash.  As the original landfill operator, the City retains a liability for ensuring that safe conditions are maintained at these sites and has worked extensively to this end with the Ohio Environmental Protection Agency (OEPA) over many years.  Several earlier ordinances (0648-1994, 3193-1995, 2249-1998, 2039-2001 and 1027-2002) authorized the establishment and subsequent modification of this contract and previous total spending has exceeded $187,000.00.  The City currently has a request pending before the Ohio EPA to either be relieved of further monitoring/mitigation responsibilities and/or have the future time parameters of these responsibilities defined.  Until the issue is adjudicated, the city's responsibilities stand.  This $10,000.00 modification is meant to provide funds for testing device maintenance as required and 2005 gas monitoring services.  As the original consultant/contractor, Floyd Browne Associates is best suited to continue to provide these services.  Billing rates were negotiated.  The vendor's contract compliance number is 34-1775535 and expires October 28, 2007.  The State of Ohio, Environmental Protection Agency derives its authority in this area from Chapter 3734 of the Ohio Revised Code.  It has further promulgated Rule #3745-27, #3745-29 and #3745-30 within the Ohio Administrative Code.
 
FISCAL IMPACT:  The Refuse Collection Division budgeted $9.57 million for service expenses in the 2005 General Fund budget.  This ordinance will authorize an expenditure of $10,000.00.  Although not specifically budgeted in the Refuse Collection Division operating budget for 2005, the Division must perform this service and therefore, will reduce expenditures in another area of the 2005 services budget.

Body
WHEREAS, the City of Columbus operated several sanitary landfills in the 1960s and 1970s; and
 
WHEREAS, methane gas is generated from the decomposition of trash and concentrations of this gas must be periodically monitored, and
 
WHEREAS, the City retains a liability for ensuring that safe conditions are maintained at these sites and has worked extensively with the Ohio Environmental Protection Agency (OEPA) to this end over the years; and
 
WHEREAS, earlier ordinances (0648-1994, 3193-1995, 2249-1998, 2039-2001 and 1027-2002) authorized the establishment and subsequent modification of a contract with Floyd Browne Associates, Incorporated, for landfill gas monitoring and mitigation services; and
 
WHEREAS, this contract must be modified and increased, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That the Public Service Director be and hereby is authorized to modify and increase an existing contract (EL002540) with Floyd Browne Associates, Incorporated, 585 Sunbury Road, Delaware, Ohio 43015-9795, by $10,000.00 for ongoing landfill gas monitoring and mitigation services and testing device maintenance.
 
SECTION 2.  That for the purpose of funding this contract modification, the expenditure of $10,000.00, or so much thereof as may be needed, be and hereby is authorized from Fund 010, the General Fund, Department No. 59-02, Refuse Collection Division, Object Level One Code 03, Object Level Three Code 3336 and OCA Code 593566.
 
SECTION 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
