The City of Columbus Department of Public Safety, Division of Police warranties on X26 tasers expired in January 2006. The Division of Police needs to extend the warranties on the tasers currently in service. Without the warranty, it now costs the Division of Police $350.00 per taser to send for repairs and this amount will increase as the tasers age. The X26 taser is an electrical device similar to a cell phone with many parts and pieces that can be damaged. Tasers have an expected life expectancy estimated at five years. Taser International through their only authorized dealer in Ohio, Vance's Outdoors Inc. has agreed to extend our warranties until the final disposition of this request.
 
The extended warranty plan costs $171.95 per taser for a four year period, there are 205 tasers in service at this time. This extended warranty would cover our tasers for repair and replacement until January 2010.  In the past year, the Division has sent approximately 60 tasers back to Taser International for repair/replacement.  Over a four year period without the extended warranty costs are anticipated to be in the range of $147,000.00 for repairs. By purchasing the extended warranty the City will realize a cost savings of over $100,000.00. The extended warranty plan through Vance's Outdoors Inc. has a total expenditure of $35,249.75.
 
This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.
 
Emergency Designation:  Emergency legislation is requested to enter into agreement for extended warranty as soon as possible since current warranty period has expired.

FISCAL IMPACT:  Although funds for taser warranties were not budgeted in the Police's General Fund budget, sufficient funding in object level 3 is available.
 
Title
 
To authorize and direct the Director of Public Safety to enter into contract for the purchase of an extended warranty on tasers with Vance's Outdoors Inc.; to waive the provisions of competitive bidding; to authorize the expenditure of $35,249.75 from the General Fund and to declare an emergency.
 
Body
 
WHEREAS, the Division of Police needs to extend the warranties on the tasers currently in service; and
 
WHEREAS, by purchasing the extended warranty the City will realize a cost savings of over $100,000.00; and
 
WHEREAS, Vance's Outdoors Inc. is the only authorized dealer in Ohio for Taser International; and
 
WHEREAS, it is necessary to waive the provisions of Section 329.06 of the Columbus City Code; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Police, Department of Public Safety, in that it is immediately necessary to enter to contract for the purchase of an extended warranty for tasers thereby preserving the public peace, property, health, safety and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1.  That the Public Safety Director be and is hereby authorized and directed to enter into a contract for the purchase of an extended warranty for tasers from Vance's Outdoors, Inc.
 
Section 2.  That in accordance with Section 329.27 of Columbus City Codes, this Council finds it is in the best interest of the City of Columbus to waive the provisions of Section 329.06 of the Columbus City Codes to permit the aforementioned purchases.
 
Section 3.  That the expenditure of  $35,249.75 or so much thereof as may be needed, be and same is hereby authorized as follows:

Section 4.  That for reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from the after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
