Explanation
The Public Service Department, Transportation Division, is engaged in the Sunbury Road Improvement project.  This project will widen Sunbury Road from two lanes to three lanes between Hildebrand Road and State Route 161 to help alleviate traffic congestion.  Contract No. EA012838 with Woolpert LLP for the design of this project was authorized by Ordinance 2920-1999, passed by City Council December 13, 1999.
 
This legislation authorizes a modification to this design contract to update the plans to accommodate ODOT's Sunbury Road/State Route 161 interchange improvements and to add sidewalks and a bike path to the length of the project.  This modification is an addition to the original scope of services but is a continuation of the existing work being performed and it would not be practical to contract with a different consultant.  
 
Woolpert LLP, contract compliance number 20-1391406 (expires January 31, 2008) was selected in accordance with provisions of City Code Chapter 329 for professional service contracts.  We have negotiated new hourly rates for this modification because the current contract is six (6) years old.  Costs have increased by approximately three percent (3%) per year for the past eight years.  The overhead rate and percentage of profit from the original contract were used because they are still valid.
 
The original contract amount was $441,108.00.  This is the first contract modification.  The total of this modification is $150,000.00.  The revised contract amount including all modifications is $591,108.00.
 
Fiscal Impact:  The Transportation Division budgeted $150,000.00 in the 2005 Capital Improvements Budget for the design modification for the Sunbury Road Improvement project.  Actual funds will be available within the 1995, 1999 Voted Streets and Highways Fund in the Roadway Improvements project as a result of the Fall 2005 bond sale. This ordinance authorizes and expenditure of $150,000.00.
 
Emergency action is requested for immediate modification of the design contract to allow construction to proceed on schedule.

Body
WHEREAS, Contract No. EA012838 was authorized by Ordinance 2920-1999, passed December 13, 1999, executed and approved by the City Attorney on January 15, 2000; and
 
WHEREAS, it is necessary to modify this contract to accommodate ODOT's Sunbury Road/State Route 161 interchange improvements and to add sidewalks and a bike path; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified and increased immediately to allow construction to proceed on schedule, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to modify and increase Contract No. EA012838 with Woolpert LLP, 409 East Monument Avenue, Dayton, Ohio 45402-1261 for design of the Sunbury Road project in accordance with the plans on file in the office of the Public Service Director.
 
SECTION 2.  That for the purpose of paying the cost thereof, the sum of $150,000.00 or so much thereof as may be needed be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 530161.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
