Explanation
 
Background:  This is consent legislation with the Ohio Department of Transportation (ODOT) for two reconstruction projects on I-270.  Projects limits for both of these projects are on the southwest side of the City on I-270 between US-62 (southern limit) and .32 miles north of Trabue Road (northern limit).  The first project is preliminary work for the ensuing major reconstruction project.  The preliminary project consists of performing concrete slab reconstruction due to poor pavement condition and widening of the inside and outside shoulders for maintenance of traffic purposes in  advance of the major reconstruction project.  Other work includes various overhead bridge concrete patching and sealing.  Construction for this project is estimated to begin in the Spring of 2010 and conclude in the Fall of 2010.  
 
The second project is a major reconstruction project consisting of pavement replacement, mainline bridge work and painting of overhead bridges.  Sidewalks will not be included with these projects since this is an interstate project.  Construction of this project is expected to begin in the Fall of 2010 and conclude in Spring of 2011.  (FRA-270-2.60 PID 76191 & FRA-270-2.60 (Slabs) PID 84445)  
 
This ordinance repeals ordinance 0532-2008, passed 4/14/08.  In this previous ordinance there was only funding identified for mainline bridge work.  Funding has now been identified by ODOT for needed pavement replacement as well as mainline bridge work and the painting of overhead bridges.
 
Since a portion of these projects lies within the City of Columbus, this consent ordinance is necessary.  The Ohio Department of Transportation will be responsible for preliminary engineering, right-of-way and construction funding.  This legislation also authorizes the Public Service Director to enter into the necessary agreements to complete these projects.
 
Fiscal Impact:  This is consent legislation for 2 projects, both of which will be funded by the Ohio Department of Transportation.  The estimated cost of the advance project is $5,000,000.00.   The estimated cost of the major reconstruction project is $86,000,000.00.  There is no cost to the City of Columbus at this time.

The following is an Ordinance enacted by the City of Columbus, Franklin County, Ohio, hereinafter referred to as the Local Public Agency (LPA), in the matter of the stated described project.
 
WHEREAS, it is necessary to repeal ordinance 0532-2008, passed 4/14/08 due to the availability of additional funds and additional work added to these project; and
 
WHEREAS, the State of Ohio has identified the need for the described projects:
 
Concrete slab repairs and widening inside and outside shoulders in advance of a future major reconstruction project.  This project also includes overhead bridge patching and sealing.  Project limits are West of US-62 to north of Trabue Road(FRA-270-2.60 Slabs PID 84445); and
 
a second project consisting of major reconstruction with pavement replacement, mainline bridge work, and painting of overhead bridges(FRA-270-2.60 PID 7619184445); now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS, OHIO:
 
 
SECTION 1.  That ordinance 0532-2008, passed 4/14/08 is hereby repealed.
 
SECTION 2.  Consent Statement
 
Being in the public interest, the LPA gives consent to the Director of Transportation to complete the above described projects.
 
SECTION 3.  Cooperation Statement
 
The LPA shall cooperate with the Director of  Transportation in the above described project as follows:
 
The City hereby agrees to cooperate with the Director of Transportation of the State of Ohio in the planning, design and construction of the identified highway improvement projects and grants consent to the Ohio Department of Transportation for the development and construction of the projects in accordance with plans, specifications and estimates as approved by the Director.
 
The Ohio Department of Transportation shall assume and bear one hundred percent of the necessary costs of the State's highway improvement projects.
 
In the event that the City requests certain features or appurtenances be included within the highway improvement projects' design and construction, and which features and appurtenances are determined by the State and the Federal Highway Administration to be not necessary for the State's highway improvement projects, the City shall, prior to the project being advertised for construction contract bidding purposes, provide appropriate documentation that its Council has appropriated, and its Auditor has certified as being available for such specific purposes, funds sufficient in amount to cover one hundred percent (100%) of the costs of incorporating such additional features or appurtenances within the State's projects, including preliminary engineering, final design, right-of-way, construction and construction engineering expenses as may be directly related thereto.
 
SECTION 4.  Utilities and Right-of-Way Statement
 
The LPA agrees that all right-of-way required  for the described projects will be acquired and/or made available in accordance with current State and Federal regulations. The LPA also understands that right-of-way costs include eligible utility costs.
 
The LPA agrees that all utility accommodation, relocation and reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT Utilities Manual.
 
SECTION 5.  Maintenance
 
Upon completion of the projects, and unless otherwise agreed, the LPA shall:  (1) provide adequate maintenance for the projects in accordance with all applicable state and federal law, including, but not limited to, Title 23, U.S.C., Section 116; (2) provide ample financial resources, as necessary, for the maintenance of the project; (3) maintain the right-of-way, keeping it free of obstructions, and (4) hold said right-of-way inviolate for public highway purposes.
 
SECTION 6.  Authority to Sign
 
The Director of Public Service of said City is hereby empowered on behalf of the City of Columbus  to enter into contracts with the Director of Transportation necessary to complete the above described projects.
 
SECTION 7.  This ordinance shall take effect and be in force from and after the earliest period allowed by law.
