CITY DEPARTMENTS' RECOMMENDATION: Approval. The 2.25± acre site consists of 11 parcels developed with a mix of uses including single-unit dwellings, auto sales, and a billboard, all in the R, Rural District, as the result of annexation into the city of Columbus. The proposed CPD, Commercial Planned Development District will allow limited commercial development, including auto sales and fuel sales, within two subareas. The proposed CPD district allows uses that are consistent with the Columbus Growth Strategy’s (2026) recommendation for “Mixed Use 2” land uses and the development text includes commitments to traffic improvements and buffering and screening from adjacent residential uses. Additionally, request is comparable with the existing zoning and development pattern along this portion of Frank Road.

WHEREAS, application #Z21-046 is on file with the Department of Building and Zoning Services requesting rezoning of 2.25± acres from R, Rural District, to CPD, Commercial Planned Development District; and
WHEREAS, the Development Commission recommends approval of said zoning change; and
WHEREAS, the Southwest Area Commission recommends approval of said zoning change; and
WHEREAS, the City Departments recommend approval of said zoning change because the requested CPD, Commercial Planned Development District will allow uses and site development standards that are consistent with both the Columbus Growth Strategy, and with the existing zoning and development pattern of this section of Frank Road; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

Situated in the State of Ohio, County of Franklin and in the Township of Franklin.
Being Lots Numbered Eight and Nine (8 & 9) of Marsdale Addition to the City of Columbus, Ohio as the same are numbered and delineated upon the recorded plat thereof, of record in Plat Book 19, Page 50, Recorder’s Office Franklin County, Ohio except 795 square feet thereof and more particularly described in Deed Book 1892, Page 165, as follows:
Being the North part of Lot Number Eight (8) in Marsdale Addition, Survey No. 717, Virginia Military Lands, as the same is numbered and delineated in Franklin County Records, Recorder’s Office, Plat Book 19, Page 50, and more particularly described as follows:

SECTION 2. That a Height District of thirty-five (35) feet is hereby established on the CPD, Commercial Planned Development District on this property.

1. INTRODUCTION: The site is located at the northwest corner of Frank Road and Brown Road and is currently developed with a used car lot and a tire repair operation. The site was zoned a mixture of Community Commercial CC and Community Service CS under the Franklin County Zoning Code and Rural District under the Columbus Zoning Code. The applicant wants to redevelop the site for retail uses and is applying as a result of the recent annexation into the City of Columbus. The site shall be subdivided into the Subarea A and Subarea B.
2. PERMITTED USES: The only permitted uses are allowed in Subarea A are C-4 including fuel sales and auto sales and those uses allowed in Subarea B are C-4 and fuel sales and excluding auto sales.
3. DEVELOPMENT STANDARDS: Unless otherwise indicated in the submitted text, the applicable development standards shall be those contained in Chapter 3356, C-4, Commercial District and Chapter 3372.701 through 709 of the Columbus City Code.
A. Density, Height, Lot Coverage, and Setback Requirements:
1. For structures and paved areas including sidewalks, lot coverage shall not exceed 85%.
B. Access, Loading, Parking, and/or Other Traffic Related Commitments:
1. All circulation, curbcuts and access points shall be subject to the review and approval of the Department of Public Service and the Franklin County Engineer's Office. Curb cuts will be identified at the time of development of the site, unless modified by the applicant at the time of the development of the site.
2. A 175 feet long westbound right turn lane (inclusive of a 50-foot diverging taper) shall be constructed at the proposed right-in/right out access point to Frank Road unless otherwise approved by the Department of Public Service.
3. In addition to the installation of the westbound right turn lane set forth in Section B(2) above, applicant shall be responsible for those traffic improvements necessary to mitigate the traffic impact of the development of the Property as determined by an updated and revised Traffic Impact Study provided by applicant or future developer and approved by the City and, provided the adjacent right-of-way is within the County’s jurisdiction, the County, in advance of the City’s approval of the final site compliance plan for the Property. The applicant or future developer shall not be financially responsible for any costs associated with the existing construction of the roundabouts currently being built by Franklin County and located at the intersections of Frank Road and Brown Road. At the election of the City, the Applicant shall, in accordance with Chapter 4309 of the Columbus City Codes, construct the required traffic improvements or pay a corresponding financial contribution to the City or, if otherwise directed by the City, to the County.
C. Buffering, Landscaping, Open Space and Screening Commitments:
1. A four foot wide buffer area will be installed along the northern and western property lines.
2. A six foot tall 100% opaque privacy fence shall be installed along the western and northern property lines.
3. Shade trees shall be planted every 25 feet apart within the 4 foot wide buffer area along the western and northern property lines.

F. Graphics and Signage Requirements:
All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code as it applies to the C-4, Commercial District of the Columbus City Code, and any variance to those requirements will be submitted to the Columbus Graphics Commission for consideration.
G. Miscellaneous Commitments:
1. The developer shall install a sidewalk along its Frank Road and Brown Road frontages.
2. Site Plan Revision Allowance. The Property shall be developed in accordance with the Site Plan; however, the Site Plan may be slightly adjusted to reflect engineering, topographical, or other site data established at the time of development and engineering plans are completed. The Director of the Department Building and Zoning Services or the Director’s designee may approve any slight adjustment to the Site Plan upon submission of the appropriate data regarding the proposed adjustment.
H. Modifications of Code Standards:

1. Natural Environment: The site contains a variety of uses, single family homes, commercial structures and vacant land.
2. Existing Land Use: The areas to the east and south are developed with commercial uses. The area to the west and north are developed with residential uses.
3. Transportation and Circulation: Access is proposed from both Frank Road and Brown Road.
4. Visual Form of the Environment: The site will be a mixture of commercial activities.
5. View and Visibility: The applicant is looking to redevelop the site.
6. Proposed Development: Commercial uses.
7. Behavior Patterns: The property will service existing residents and businesses in the area as well as motorists traveling along Frank Road and Brown Road.
8. Emissions: No adverse effect from emissions shall result from the proposed development.
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
