Explanation
BACKGROUND: The Ohio Department of Health has designated Columbus Public Health to conduct various activities on their behalf regarding the initial implementation of Chapter 3794 of the Ohio Revised Code, the Smoke-Free Workplace Program. The Board of Health has been awarded a grant from the Ohio Department of Health in an amount not to exceed $21,905 for these activities through June 30, 2007. Under this grant, the Ohio Department of Health will reimburse Columbus Public Health for costs associated with follow-up actions regarding complaints filed for violations of Chapter 3794 of the ORC, and for the provision of educational information provided to places of employment and to the public.
This ordinance is submitted as an emergency so as to allow the financial transaction to be posted in the City's accounting system as soon as possible. Up to date financial posting promotes accurate accounting and financial management.
FISCAL IMPACT: The Ohio Department of Health will reimburse Columbus Public Health $21,905 for costs associated with the initial implementation of Chapter 3794 of the Ohio Revised Code. The funds will be deposited into the Health Department Grants Fund.

WHEREAS, the Ohio Department of Health has a need for activities to be provided on their behalf for the initial implementation of Chapter 3794 of the Ohio Revised Code, Smoke-Free Workplace Program; and,
WHEREAS, the Ohio Department of Health has awarded Columbus Public Health a grant in the amount of $21,905 to provide those activities through June 30, 2007; and,
WHEREAS, an emergency exists in the usual daily operation of Columbus Public Health in that it is immediately necessary to accept this grant from the Ohio Department of Health for the immediate preservation of the public health, peace, property, safety and welfare; Now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Board of Health is hereby authorized and directed to accept a grant from the Ohio Department of Health for the provision of various activities necessary for the initial implementation of the Smoke-Free Workplace Program through June 30, 2007.
SECTION 2. That from the monies in the Fund known as the Health Department Grants Fund, Fund No. 251, and from all monies estimated to come into said fund from any and all sources during the 12 months ending December 31, 2007, the sum of $21,905 is hereby appropriated to the Health Department, Department No. 50-01, as follows:

SECTION 3. That the monies appropriated in the foregoing Section 2 shall be paid upon the order of the Health Commissioner, and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
SECTION 4. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
