Explanation
The Public Service Department, Transportation Division, recently received a request from Mary Lane asking that the City grant an encroachment easement into the alley south of East Broad Street, west of Franklin Park West. The granting of the requested encroachment easement will allow an existing 60+ year old garage foundation to remain. After investigation it has been determined that the granting of the requested encroachment easement will not adversely affect the City's continued use of the alley and that the requested encroachment easement should be granted. A value of $500.00 has been established for the granting of this easement.
The City will receive a total of $500.00, to be deposited in Fund 748, Project 537650, as consideration for the granting of the requested easement.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request from Mary Lane asking that the City grant an encroachment easement into the alley south of East Broad Street, west of Franklin Park West; and
WHEREAS, the granting of the requested encroachment easement will allow an existing 60+ year old garage foundation to remain; and
WHEREAS, after investigation it has been determined that there are no objections to the granting of the requested encroachment easement; and
WHEREAS, a value of $500.00 has been established for the granting of the requested encroachment easement; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Public Service Department be and is hereby authorized to execute those documents necessary to grant the following described encroachment easement to Mary Lane; to-wit:
Situated in the State of Ohio, County of Franklin, City of Columbus and being more particularly described as follows:
Beginning at the northwest corner of Lot #4 in Franklin Park as delineated in Plat Book 4, Page 20, in the offices of the Recorder, Franklin County, Ohio, said corner also being the intersection of the east line of an unnamed alley (18 feet wide) and the south line of an unnamed alley (20 feet wide);
Thence, northeasterly along the north line of said Lot 4 and the south line of said unnamed alley (20 feet wide), 12.00 feet to the True Place of Beginning for this easement;
Thence northwesterly, perpendicular to the south line of said 20 feet wide alley and the north line of said Lot 4, 2.50 feet,
Thence, northeasterly, parallel to the south line of said 20 feet wide alley and the north line of said Lot 4, 10 feet,
Thence, southeasterly, perpendicular to the south line of said 20 feet wide alley and the north line of said Lot 4, 2.50 feet,
Thence, southwesterly along the north line of said Lot 4 and the south line of said unnamed alley (20 feet wide), 10.00 feet to the True Place of Beginning. Containing 25 square feet, more or less.
Section 2. That the $500.00 to be received by the City as consideration for the granting of the requested encroachment easement shall be deposited in Fund 748, Project 537650.
Section 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
