Explanation
Ordinance 1876-2000 established the "Mayor's Charitable Trust Fund (hereafter referred to as fund 224) to fund "scholarships, education, training, employment, learning, recreation, extended day care programs, fitness, cultural, health, learning tools, supportive services and equipment." These services were provided through the Office of Education's Capital Kids program, which was primarily supported by general and CDBG funds, but was often supplemented by funding from fund 224. In 2009, however, on-going budget challenges resulted in the elimination of the Office of Education. Some activities, previously housed in Education, including the Capital Kids program, were transferred to the Department of Recreation and Parks. As fund 224 was established to fund the activities of the Capital Kids program, it is necessary to transfer authority of this fund to the Department of Recreation and Parks, thereby giving its Director full authority to make expenditures from it for programming expenses related to the Capital Kids program.
Contributions to fund 224 come from individual and corporate donors as well as foundation support. Upon transfer to Recreation and Parks, expenditures of these monies will continue to be limited to those noted above. Additionally, it is the intent of this ordinance that these services continue to be provided through the Capital Kids program.
FISCAL IMPACT: There is no fiscal impact of this ordinance.
Title
To authorize the City Auditor to transfer authority of the Mayor's Charitable Trust Fund from the Department of Education to the Department of Recreation and Parks to be used solely for services provided through the Capital Kids program, to authorize the Recreation and Parks Director to act on behalf of the City with all powers and authority over the aforementioned fund formerly granted to the Education Director, and to declare an emergency. WHEREAS, Ordinance 1876-00 established the Mayor's Charitable Trust Fund, fund 224 for the sole purpose of providing certain services such as scholarships, education, training, employment, learning, recreation, extended day care programs, fitness, cultural, health, learning tools, supportive services and equipment and that these services were to be provided through the Office of Education and/or the Office's Capital Kids programs; and
WHEREAS, the Office of Education has been eliminated and the Capital Kids program and expenditure authority hereto has been transferred to the Department of Recreation and Parks; and
WHEREAS, the authority of the Mayor's Charitable Trust fund, fund 224 needs to be transferred to Recreation and Parks coincident with the transfer of the Capital Kids programming; and
WHEREAS, an emergency exists in the daily operations of the City of Columbus in that it is immediately necessary to transfer authority of fund 224 to the Director of Recreation and Parks so that he and his designee can access established documents to be used for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Auditor be and is hereby authorized and directed to transfer authority from the Office of Education 40-04 to the Department of Recreation and Parks 51-01 to access both appropriated and unappropriated monies in fund 224 to supplement expenses associated with the Capital Kids programs.
Section 2. That the Director of Recreation and Parks is hereby authorized to act on behalf of City and with all authority and powers formerly granted to the Director of the Office of Education with respect to fund 224.
Section 3. That the monies in the foregoing section 1 shall be paid upon order of the Director of Recreation and Parks and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
Section 4. That monies in the fund are hereby deemed appropriated solely for carrying out the intended purpose of this ordinance.
Section 5. That for reasons state in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be enforced from and after its passage and approval by the Mayor, or ten days after if the Mayor neither approves nor vetoes the same.
