Background:
Bids were received by the Recreation and Parks Department on May 31, 2012 for the Westgate Patio Improvements Project as follows:

The work for which proposals are invited consists of demolition of existing concrete and asphalt patios and the supply and installation of new asphalt and concrete walkways; two stamped concrete patios; stone wall and stone veneer columns; concrete foundations, iron fencing and foundations; site furnishings; trees and shrubs; fine grading and seeding; drainage systems; two lights, and other such work as may be necessary to complete the contract in accordance with the plans and specifications. Emergency Justification:
An emergency exists in the usual daily operations of the Recreation and Parks Department in that it is immediately necessary to enter into said contract so that work may proceed as quickly as possible so that the work can be completed this construction season.

WHEREAS, bids were received by the Recreation and Parks Department on May 31, 2012 for the Westgate Patio Imoprovements project and will be awarded to Builderscape, Inc. on the basis of the lowest and best responsive and responsible bidder; and
 
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into contract with  Builderscape, Inc. for the Westgate Patio Improvements Project so that work may proceed as quickly as possible to be constructed during the fall construction season thereby preserving the public, health, peace, safety, welfare;  NOW, THEREFORE,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with  Builderscape, Inc. for the Westgate Patio Improvements Project in accordance with the plans and specifications on file in the Recreation and Parks Department.
           
SECTION 2.   That the expenditure of $167,200 or so much thereof as may be necessary to pay the cost thereof, be and is hereby authorized from the Voted Recreation and Parks Bond Fund 702 as follows:

SECTION 3.   That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this legislation.
 
SECTION 4.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby  declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or 10 days after passage if the Mayor neither approves nor vetoes the same.
