Explanation
1. Background: This ordinance authorizes the City Attorney to acquire certain property rights, and to expend monies in connection with the Big Walnut Augmentation Rickenbacker Interceptor (BWARI) Lockbourne Intermodal Subtrunk Project. The preliminary amount of funding originally made available for this project was done so with the understanding that additional monies may be necessary at certain points during the acquisition process to cover anticipated settlement costs, and those staff hours necessary to the projects completion.
This ordinance is part of a continuing process based on the following ordinances: Ordinance 1814-2007 was passed November 19, 2007 and provided the initial funding to begin the necessary title searches, appraisal services and staff costs; Ordinance 0362-2009 passed March 30, 2009 and Ordinance 1659-2010 authorized the City Attorney to acquire certain property rights, and to expend monies in connection with the Big Walnut Augmentation Rickenbacker Interceptor (BWARI) Lockbourne Intermodal Subtrunk Project.
The preliminary amount of funding originally made available for this project was done so with the understanding that additional monies may be necessary at certain points during the acquisition process to cover anticipated settlement costs, and those staff hours necessary to the projects completion. The following legislation authorizes the transfer and expenditure of additional funds within the Sanitary Sewer Build America Bond (B.A.B's) Fund for payment of acquisition costs in connection with the Big Walnut Augmentation Rickenbacker Interceptor (BWARI) Lockbourne Intermodal Subtrunk Project.
2. Fiscal Impact: This ordinance authorizes the transfer a total of $255,000.00 of funds from within the Sanitary Sewer Build America Bond (B.A.B's) Fund, Fund 668 for the purpose of providing the necessary funding required for this expenditure, to provide sufficient budget authority, and to amend the 2011 Capital Improvement Budget.
3. Emergency Designation: Emergency action is requested to allow the additional funds necessary to the completion of the acquisition phase of this project to be transferred in to the appropriate fund and expended without delay.

To provide additional funding necessary to the on going acquisition of fee simple title and lesser interests in connection with the Big Walnut Augmentation Rickenbacker Interceptor (BWARI) Lockbourne Intermodal Subtrunk Project; to authorize the transfer and expenditure of $255,000.00 from within the Sanitary Sewer Build America Bond (B.A.B's) Fund; to amend the Sanitary Sewer Build America Bond (B.A.B's) Fund for the Division of Sewerage and Drainage; amend the 2011 Capital Improvement Budget; and to declare an emergency. WHEREAS, the City of Columbus is engaged in the Big Walnut Augmentation Rickenbacker Interceptor (BWARI) Lockbourne Intermodal Subtrunk Project; and
WHEREAS, it is necessary to authorize the transfer of funds within the Sanitary Sewer Build America Bond (B.A.B's) Fund to provide sufficient funding for the aforementioned project expenditure; and
WHEREAS, it is necessary to authorize an amendment to the amend the 2011 Capital Improvement Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and
WHEREAS, it is necessary for City Council to authorize the expenditure of $255,000.00 from the Sanitary Sewer Build America Bond (B.A.B's) Fund; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewers and Drainage, in that it is immediately necessary to provide additional funding necessary to the on going acquisition of fee simple title and lesser interests in connection with the Big Walnut Augmentation Rickenbacker Interceptor (BWARI) Lockbourne Intermodal Subtrunk project for the preservation of the public health, peace, property and safety; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Attorney be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the Big Walnut Augmentation Rickenbacker Interceptor (BWARI) Lockbourne Intermodal Subtrunk project, CIP 650491-100002.
Section 2. That the City Auditor is hereby authorized to transfer $255,000.00 within the Sanitary Sewer Build America Bonds (B.A.B.s) Fund, Fund 668; Object Level Three 6601; Division of Sewerage and Drainage; Div. 60-05:

Section 3. That the 2011 Capital Improvements Budget Ordinance No. 0266-2011 is hereby amended as follows, to provide sufficient budget authority for the award of the agreement stated herein:

Section 4. That the expenditure of $255,000.00, or as much thereof as may be needed, is hereby authorized from the Sanitary Sewer Build America Bonds (B.A.B.s) Fund | Fund 668 | Division 60-05 | Project 650491-100002 | OCA Code 684912 | Object Level Three 6601 in order to provide additional funding necessary to the on going acquisition of fee simple title and lesser interests in connection with the Big Walnut Augmentation Rickenbacker Interceptor (BWARI) Lockbourne Intermodal Subtrunk Project
Section 5. That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
Section 6. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
Section 7. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
Section 8. That for the reasons stated in the preamble hereto, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
