Explanation
 
Background:
On May 23, 2005, Council approved ordinance 0804-2005 that allowed for the restructuring of the Oracle licensing and maintenance  and support for CourtView 2000, the Municipal Court case management system.  The restructuring agreement  included the cost for continuing maintenance and support for the period of May 31, 2006 through May 30 2007 that would be paid quarterly.  This ordinance will allow for these payments.  Emergency declaration is requested to enable the Franklin County Municipal Court Clerk to pay the first installment on a timely basis.
 
Fiscal Impact:  The $46,464.00 is available within the Franklin County Municipal Court Clerk's computer revenue fund.

Body
 
Whereas, it is necessary to renew the Oracle maintenance and support agreement for CourtView 2000 for the period of May 31, 2006 through May 30, 2007 to be paid on a quarterly basis; and
 
Whereas, the parameters for this support renewal was addressed in an agreement by ordinance 0804-2005, approved by Council on May 23, 2005; and
 
Whereas, an emergency exists in the daily operation of the Franklin County Municipal Court Clerk's office in that it is immediately necessary to issue a purchase to the Oracle Corporation for ongoing and uninterrupted support thereby preserving the City's public health, peace, safety, and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Finance & Management be and is herby authorized and directed to issue a purchase order to the Oracle Corporation on behalf of the Franklin County Municipal Court Clerk for the purpose of renewing CourtView Oracle # 1488683 maintenance support for the period of May 31, 2006 through May 30, 2007.
 
Section 2.  That the purpose of paying the cost hereof the sum of $46,464.00 or so much thereof as may be necessary is hereby authorized to be expended from the Franklin County Municipal Court Clerk's special revenue fund, organization 2601, fund 227, subfund 02, oca 260208, object level 1-03, object level 03: 3369- $46,464.00.
 
Section 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measurer and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
