1. BACKGROUND:
A.) Need: This legislation authorizes the Director of Public Utilities to modify the construction contract with Reynolds, Inc., for the Adena Brook Ravine Area Sanitary Sewer Improvements Project; to transfer $38,587.50 within the Voted Sanitary Sewer Bond Fund; and to amend the 2007 Capital Improvements Budget.
This modification will provide for the payment of five ADS FlowShark flow monitoring devices that the Division of Sewerage and Drainage has determined to be beneficial and necessary in order to provide detailed capacity information for the Clintonville community area. This modification is necessary to provide separate funding for the equipment, because the Ohio Water Development Authority (OWDA) rejected these items as ineligible for payment within a change order, under the terms of the loan.
The Division has standardized installing this equipment for all Clintonville community Inflow/Infiltration projects, in order to quantify the reduction of inflow and infiltration that the improvements have had upon their capacity. The Division, through a contract with Metcalf and Eddy, has previously collected pre-rehabilitation flow data for these project areas. This information is needed for engineering personnel to determine what additional downstream infrastructure rehabilitation/replacement projects will be required to continue enhance infrastructure capacity.

2.) FISCAL IMPACT: This legislation includes a transfer of cash between projects within the Sanitary Sewer Bond Fund and an amendment of the 2007 Capital Improvements Budget to establish sufficient funds and budget authority to cover the expenditure of $38,587.50 upon passage of this ordinance.
3.) PROJECT LOCATION: This project's boundaries are: Whetstone Park of Roses (High Street) on the west, Indianola Avenue on the east, Cooke Road on the north, and Blenheim Road on the south.

WHEREAS, Contract No. EL005482 was authorized by Ordinance No. 1111-2005, as passed by Columbus City Council on July 20, 2005 for purposes of authorizing the Director of Public Utilities to enter into contract with Reynolds, Inc., for the Adena Brook Ravine Area Sanitary Sewer Improvements Project; and
WHEREAS, the Ohio Water Development Authority has determined that the costs associated with the installation of flow monitoring equipment is ineligible under the terms of the loan agreement for the subject project; and it is therefore necessary to authorize separate funding for the payment of these items under the construction contract, to ensure the installation of said equipment occurs, pursuant to capturing and providing Division of Sewerage and Drainage engineering personnel, with the capacity data needed to determine future downstream capital improvement projects; and
WHEREAS, it is necessary to transfer funds within the Voted Sanitary Sewer Bond Fund to provide sufficient funding for the aforementioned project expenditure; and
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities is requesting that this Council authorize the Director of Public Utilities to modify the construction contract to authorize the expenditure of the necessary funds from the Voted Sanitary Sewer Bond Fund to allow for payment to Reynolds, Inc. for the purchase of five (5) ADS FlowShark flow monitoring devices for the Adena Brook Ravine Area Sanitary Sewer Improvements project; at the earliest practical date; and
WHEREAS, in order to facilitate the aforementioned capital improvement project related transaction and associated construction contract modification agreement, it is necessary to transfer funds within the Voted Sanitary Sewer System Bond Fund and to amend the 2007 Capital Improvements Budget, at the earliest practicable date; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. EL005482 with Reynolds, Inc., 4520 North State Rd. 37, Orleans, Indiana, 47452 for construction of the Adena Brook Ravine Area Sanitary Sewer Improvements Project in order to provide for additional work in accordance with the terms and conditions of the contract on file in the Office of the Division of Sewerage and Drainage.
Section 2. That the City Auditor is hereby authorized to transfer $38,587.50 within the Voted Sanitary Sewer Bond Fund No. 664, Division of Sewerage and Drainage, Division 60-05, Object Level3 6630 as follows:

Section 3. That the 2007 Capital Improvements Budget Ordinance No. 0733-2007 is hereby amended as follows, to provide sufficient budget authority for the execution of the modification stated herein:

Section 4. That for the purpose of paying the cost of the contract modification, the following expenditure, or as much thereof as may be needed, is hereby authorized as follows: Division 60-05, Fund 664, Project 650665, Object Level3 6630, OCA 664665, Amount $38,587.50.
Section 5. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account by monies from more than one source.
Section 6. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
Section 7. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
Section 8. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
