Explanation
Broad/Galloway Associates, LLC, an Ohio limited liability company, by M/I Homes Of Central Ohio, an Ohio limited liability company, Managing Member, by Stephen M. Caplinger, Vice President Land Operations, and by Dominion Homes, Inc., an Ohio corporation, Member, by Joseph A. Sugar III, Vice President Land Acquisitions, has submitted the plat titled Summerlyn Section 2 to the City Engineer's Office for review and approval. This plat has been reviewed and approved by the City Engineer. The following legislation allows the City to accept said plat for property located south of West Broad Street and west of Galloway Road.

Caplinger, Vice President Land Operations, and by Dominion Homes, Inc., an Ohio corporation, Member, by Joseph A. Sugar III, Vice President Land Acquisitions; and to declare an emergency.

WHEREAS, the plat titled Summerlyn Section 2 (hereinafter "plat"), has been submitted to the City Engineer's Office for approval and acceptance; and
WHEREAS, Broad/Galloway Associates, LLC, an Ohio limited liability company, by M/I Homes Of Central Ohio, an Ohio limited liability company, Managing Member, by Stephen M. Caplinger, Vice President Land Operations, and by Dominion Homes, Inc., an Ohio corporation, Member, by Joseph A. Sugar III, Vice President Land Acquisitions, owner of the platted land, desires to dedicate to the public use all or such parts of the Avenue, Court, Drives, Place, Road and Street shown on said plat and not heretofore so dedicated; and
WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the acceptance of this plat so development of this subdivision can proceed as currently scheduled thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the plat titled Summerlyn Section 2 on file in the office of the City Engineer, Transportation Division, be and the same is hereby accepted.
Section 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
