Explanation
BACKGROUND:
This ordinance appropriates $40,000.00 to the Franklin County Municipal Court Judges from the home incarceration program fund for 2011 to provide sufficient funds to pay the cost of probationers to be electronically monitored. This legislation is considered an emergency measure to ensure the continuation of uninterrupted payments to the vendors.
FISCAL IMPACT: There are sufficient funds available within the home incarceration program fund to support the requested appropriation level for 2011.
Title
To authorize the appropriation of $40,000.00 for 2011 from the unappropriated balance of the Franklin County Municipal Court Judges home incarceration program fund for all anticipated expenses associated with the electronic monitoring services; and to declare an emergency. ($40,000.00)
Body
Whereas, an appropriation of these funds is necessary in order to continue with the electronic monitoring services and the payment thereof; and
Whereas, an emergency exists in the usual daily operation of the Franklin County Municipal Court Judges in that it is immediately necessary to appropriate the aforementioned funds, in order to provide sufficient funds to pay the cost of electronic monitoring services, thereby preserving the public health, peace, property, safety and welfare; Now, Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
Section 1. That from the unappropriated monies in special revenue fund known as the home incarceration program fund, fund number 226, subfund number 003, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2011 the sum of $40,000.00 is appropriated to the Franklin County Municipal Court Judges, department 25 as follows: oca 250179 (home incarceration - self pay), object level 1 - 03, object level 3 - 3431.
Section 2. That the monies appropriated in the foregoing Section 1 shall be paid upon order of the Franklin County Court Judges; and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
