AD CREEK, LLC, an Ohio limited liability company, by M/I SCHOTTENSTEIN HOMES, INC., an Ohio corporation, Managing Member, by STEPHEN M. CAPLINGER, Vice President Land Operations, HOMEWOOD CORPORATION, an Ohio corporation, Member, by JOHN H. BAIN, Chief Executive Officer, and DOMINION HOMES, INC., an Ohio corporation, Member, by ROBERT A. MEYER, JR., Senior Vice President, has submitted the plat titled LAKEWOOD SECTION 6 to the City Engineer's Office for review and approval.  This plat has been reviewed and approved by the City Engineer.  The following legislation allows the City to accept said plat for property located east of Alton & Darby Creek Road and north of Pinefield Drive.

CAPLINGER, Vice President Land Operations, HOMEWOOD CORPORATION, an Ohio corporation, Member, by JOHN H. BAIN, Chief Executive Officer, and DOMINION HOMES, INC., an Ohio corporation, Member, by ROBERT A. MEYER, JR., Senior Vice President and to declare an emergency.

WHEREAS, the plat titled LAKEWOOD SECTION 6 (hereinafter "plat"), has been submitted to the City Engineer's Office for approval and acceptance; and
 
WHEREAS, AD CREEK, LLC., an Ohio limited liability company, by M/I SCHOTTENSTEIN HOMES, INC., an Ohio corporation, Managing Member, by STEPHEN M. CAPLINGER, Vice President Land Operations, HOMEWOOD CORPORATION, an Ohio corporation, Member, by JOHN H. BAIN, Chief Executive Officer, and DOMINION HOMES, INC., an Ohio corporation, Member, by ROBERT A. MEYER, JR., Senior Vice President, owner of the platted land, desires to dedicate to the public use all or such parts of the Drives shown on said plat and not heretofore so dedicated; and
 
WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat and; now, therefore
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service and Transportation in that it is immediately necessary to pass this ordinance as an emergency measure because construction of the public improvements is ahead of schedule.  Construction will be completed approximately 3-4 weeks before the subdivisin plat would be approved, if  by 30 day legislation.  Therefore, we would like to request emergency action so that we are able to record the plat at about the same time the construction ends.  This would expedite the sale of the lots and allow for the submittal of  building permits for new home construction for the preservation of the public health, peace, property, safety, and welfare; now therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.      That the plat titled LAKEWOOD SECTION 6 on file in the office of the City Engineer, Transportation Division, be and the same is hereby accepted.
 
Section 2.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
 
That for the reasons stated inthe preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
