Title: To authorize and direct the Director of the Department of Development to amend the Reimbursement Agreement For Northland Mall Demolition with Columbus Urban Growth Corporation by decreasing the dollars allocated to this contract by One Hundred and Fifty Thousand Dollars ($150,000) and by increasing the Scope of Services to allow Columbus Urban Growth Corporation to be reimbursed for project administration services; and to declare an emergency. Explanation
 
Background: This legislation is to modify the Scope of Services and reduce the dollars allocated to the existing Reimbursement Agreement For Northland Mall Demolition with Columbus Urban Growth Corporation.  The existing agreement allows payments for demolition of certain structures at the former Northland Mall site.  Costs for demolition work were lower than estimated and $200,000 will remain unspent on the contract.  A companion project, Northland Roadways Phase 1, needs an additional $150,000 to pay for higher than estimated engineering costs.  The first modification to the Northland Mall Demolition Agreement will reduce the total dollars from $1,100,000 to $950,000.  The second modification will allow payments for administrative fees to Columbus Urban Growth Corporation for the management of the Northland demolition project up to $50,000.  Companion legislation increases the Northland Roadways Phase 1 contract by $150,000, from $1,300,000 to $1,450,000.
 
Fiscal Impact: The total contract dollars will decrease by $150,000, to $950,000.  These funds will be transferred to the Northland Roadways Phase 1 contract in order to complete all roadway work.  
 
Emergency Justification: This legislation is an emergency measure to allow all funds to be amassed for the roadway project prior to commencing construction.

Body
 
WHEREAS, the Department of Development entered into an agreement (contract #DL008011) with the Columbus Urban Growth Corporation for the demolition of certain structures at the former site of Northland Mall; and
 
WHEREAS, the cost of demolition is $200,000.00 lower than what was originally estimated; and
 
WHEREAS, a companion project, the Northland Roadways Phase 1, is in need of $150,000.00 more to pay for higher than estimated engineering fees; and
 
WHEREAS, the Northland Mall Demolition Agreement needs to be amended to reduce the dollars allocated by $150,000.00; and
 
WHEREAS, Columbus Urban Growth Corporation has and will continue to engage in project management activities in order to complete the terms of the contract; and
 
WHEREAS, the scope of services for the Agreement (detailed in Exhibit A) needs to be amended to reflect allowable payments, up to $50,000.00, for administration fees related to project management; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to amend this contract all for the immediate preservation of the public health, property, safety and welfare; now, therefore,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.       That the Director of the Department of Development is hereby authorized and directed to amend DL008011 with the Columbus Urban Growth Corporation by decreasing the dollars allocated by $150,000.00 and by increasing the Scope of Services to include up to $50,000.00 payable for administrative fees for project management services by Columbus Urban Growth Corporation.      
 
Section 2.       That it is further agreed that in all other aspects, this contract remains unchanged.      
 
Section 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
