Rezoning Application Z01-042a
 
Ordinance #1349-02, passed September 9, 2002, rezoned 65.73+ acres located at 1477 Dyer Road from the L-M, Limited Manufacturing, MHP, Mobile Home Park and R, Rural Districts to the PUD-6, Planned Unit Development District.  The PUD plan, as established by Ordinance #1349-02, included a specific lot and street layout.  This legislation will amend Ordinance #1349-02, passed on September 9, 2002, by modifying the PUD plan to permit a new lot and street layout that allows for the dwellings on the twelve lots along Dyer Road to face Dyer Road instead of backing onto it and to  provide access to the front of the dwellings instead of the rear of the dwellings from  new streets named Wales Place and Channel Place that was not shown on the original PUD plan.  Overall the total number of lots has been reduced from 309 to 289.  Additionally lots 93 through 97 on the original PUD plan, which are adjacent to Interstate 71, have been decreased in depth, with the land that was removed being added to Reserve B.  This amendment does not alter any other requirements established by Ordinance #1349-02.

WHEREAS, it is necessary to amend Ordinance #1349-02, passed September 9, 2002, to reconfigure the street and lot layout  for 1477 DYER ROAD (43123), being 65.73± acres located on the south side of Dyer Road to the west of Interstate 71; and
 
WHEREAS, all other aspects of the PUD plan contained in Ordinance #1349-02 are unaffected by this amendment and remain in effect; and
 
WHEREAS, an emergency exists in the daily operation of the Department of Development in that it is immediately necessary to amend the PUD plan of Ordinance #1349-02 concerning lot and street layout, for the preservation of the public health, peace, property and safety, now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
SECTION 1.  That existing Section 3 of Ordinance #1349-02, passed September 9, 2002 (Z01-042), be amended by repealing said Section 3 in its entirety and that a new Section 3 is adopted and reading as follows:
SECTION 2.  That existing Section 3 of Ordinance #1349-02 (Z01-042), passed on September 9, 2002, be and is hereby repealed.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval if the Mayor neither approves nor vetoes the same.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved PUD-6, Planned Unit Development District and Application among the records of the Building Services Division as required by Section 3311.09 of the Columbus City Codes; said plan being titled, "SUSSEX PLACE", signed by Donald T. Plank, Attorney for the Applicant, dated November 3, 2003.
