AN06-004
BACKGROUND:      This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN06-004 a certain petition for annexation as described in the ordinance which is attached hereto. More than sixty days have elapsed since August 16, 2006, the date of receipt from the Board of County Commissioners of Franklin County.
 
These are submitted in accordance with the Ohio Revised Code.
 
FISCAL IMPACT:      Provision of municipal services for a proposed annexation area has no fiscal impact.  However, provision of the stated services does represent cost to the city.  The annexation of land also has the potential to create revenue to the city.
 
Title
 
To accept the application (AN06-004) of Laela R. Tague-Behler & Robert A. Behler III for the annexation of certain territory containing 0.74 ± Acres in Perry Township.
 
Body
 
WHEREAS,   a petition for the annexation of certain territory in Perry Township was duly filed by Laela R. Tague-Behler & Robert A. Behler III on March 22, 2006; and
 
WHEREAS,  the said petition was duly considered by the Board of County Commissioners of  Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated April 25, 2006; and
WHEREAS,  the Board of County Commissioners of  Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on August 16, 2006; and
WHEREAS,  sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and
 
WHEREAS,  it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore,  
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1.  That the proposed annexation as applied for in the petition of Laela R. Tague-Behler & Robert A. Behler III being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio March 22, 2006 in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated April 25, 2006, be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus.  Said territory is described as follows:
 
Situated in the State of Ohio, County of Franklin, and Township of Perry, being a part of part of Section 1, Township 2, Range 19, United States Military Lands, and being a part of a 0.826 acre tract conveyed to Robert and Laela Behler, of record in Instrument 200310210337531, all of the above aforementioned references to the Recorder's Office, Franklin County, Ohio, and bounded and describes as follows:
 
Beginning at the northerly right of way line of West Case Road., being located approximately 30 feet north of the centerline of said West Case Road. (As established by a Highway Easement to Franklin County as recorded in Deed Book 3200, Page 312), being on the westerly property line of said 0.826 acre tract, also being on the easterly line of a 0.665 acre tract as conveyed to Richard D. & Elizabeth K. Chapman, and also being in the existing City of Columbus Corporation line as established by Ordinance No. 2050- 96 as recorded in Official Record 33320 Page E 04;
 
thence, in a northerly direction, a distance of approximately 270 feet, along the westerly line of said 0.826 acre tract, along the easterly line of said 0.665 acre tract, also being along the said existing City of Columbus Corporation line, a distance of approximately 270 feet to the northwest property corner of said 0.826 acre tract of land, being also the south line of a 7.609 acre tract conveyed to the State of Ohio;
 
thence, in a easterly direction, a distance of approximately 120 feet, along the northerly property line of said 0.826 acre tract of land, along the southerly line of said 7.609 acre tract, also being along the said existing City of Columbus Corporation line, to the northeasterly corner of said 0.826 acre tract of land, and the northwesterly corner of a 0.5 acre tract as conveyed to Greg A. Bourdo & Brie A. Shaffer;
 
thence, in a southerly direction, a distance of approximately 270 feet, leaving said existing City of Columbus Corporation line, along the easterly line of said 0.826 acre tract of land, along the westerly line of said 0.5 acre tract, to the northerly right of way line of West Case Road;
 
thence, in a westerly direction, a distance of approximately 120 feet, along said northerly right of way line of West Case Road, to the TRUE PLACE OF BEGINNING, and containing approximately 0.74 acre's of land, more or less.
 
Section 2.  That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
