Explanation
 
BACKGROUND:  This legislation authorizes the Public Service Director enter into a contract with Nickolas Savko & Sons for an amount up to $7,293,646.53 for the Lane Avenue Roadway Improvement project for the Transportation Division and to pay construction inspection costs up to $616,125.00.  This improvement details the widening to five lanes and the construction of curb, gutters and sidewalk on Lane Avenue from the Lane Avenue bridge east to Tuller Avenue (see attached map).  The project also includes a new storm sewer system, waterline replacement, mast arm signal poles, lighting and tree plantings.  The Water and Sewerage and Drainage Divisions will reimburse the Transportation Division for their respective components of the project (construction of new water lines and new storm and sanitary lines, respectively).  The Notice to Proceed is estimated to be issued on July 7, 2003.  Project completion is estimated at 540 days.  The project was advertised in the Columbus City Bulletin and Dodge Reports and by the Builders Exchange by the Transportation Division.  Twenty-five contractors were solicited (23 majority, 2 minority) and five bids were received (5 majority, 0 minority) and tabulated on May 15, 2003 as follows:

Bid award will be made to Nickolas Savko & Sons, Inc., CC# 31-0907362 (expires May 13, 2006), for the lowest, best, most responsive, and most responsible bid.
 
FISCAL IMPACT:  The Lane Avenue Roadway Improvement project is currently budgeted in the pending 2003 Capital Improvements Budget.  This ordinance amends the 2002 Capital Improvements Budget and certifies funding from the Special Income Tax Fund as a temporary measure until the next bond/note sale occurs, at which point that Fund will be reimbursed.
 
Emergency action is requested for the immediate execution of the construction contract for the earliest possible start of construction so that the improvement may be completed in the 2004 construction season.

Body
 
WHEREAS, bids were received and tabulated on May 15, 2003 for the Lane Avenue Roadway Improvement project; and
 
WHEREAS, a satisfactory bid has been received; and
 
WHEREAS, it is necessary to provide for construction inspection costs; and
 
WHEREAS, it is necessary to certify monies against the Special Income Tax Fund as a temporary funding source pending the next bond/note sale, after which the monies so certified will be reimbursed to the Special Income Tax Fund; and
 
WHEREAS, it is necessary to amend the 2002 Capital Improvements Budget to include this project, and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Departmetn, Transportation Division, in that the contract should be awarded immediately so that the work may proceed without delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the 2002 Capital Improvements Budget be and hereby is amended as follows:

SECTION 2.   That from the unappropriated monies in the Special Income Tax Fund, Fund 430, and from the monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2003, the sum of $7,700,797.07 be and hereby is appropriated to the City Auditor, Department No. 22-01, Object Level One Code 10, Object Level Three Code 5500, OCA Code 920023.
 
SECTION 3.  That the City Auditor is hereby authorized to transfer said funds to the Voted 1995, 1999 Streets and Highways Fund, Fund 704, at such time as it is deemed necessary by the City Auditor and to expend said funds or so much thereof as may be necessary.
 
SECTION 4.  That $7,700,797.07 is hereby appropriated within the Voted 1995, 1999 Streets and Highways Fund, Fund 704, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6631, OCA Code 644385, Project 590401 to pay for construction of the Lane Avenue Roadway Improvement project for the Transportation Division.
 
SECTION 5.  That upon obtaining other funds for this capital improvement, the City Auditor is hereby authorized to repay the Special Income Tax Fund the amount transferred under Section 3 above, and said funds are hereby deemed appropriated for such purpose.
 
SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract(s) or contract modification(s) associated with the expenditure of the funds transferred under Section 3 above.
 
SECTION 7.  That the City intends that this ordinance constitute an official intent for purposes of Section 1.150-2(e) of the Treasury Regulations promulgated pursuant to the Internal Revenue Code of 1986, as amended.
 
SECTION 8.  That the Public Service Director be and hereby is authorized to enter into a contract with Nickolas Savko & Sons, Inc., 4636 Shuster Road, Columbus, Ohio 43214, for the construction of the Lane Avenue Roadway Improvement project in the amount of $7,293,646.53 for the Transportation Division in accordance with the specifications and plans on file in the office of the Public Service Director, which are hereby approved, and to obtain and pay for the necessary inspection costs associated with the project up to a maximum of $616,125.00 therefore.
 
SECTION 9.  That for the purpose of paying the cost of the contract and inspection, the sum of $7,909,771.53, or so much thereof as may be needed, is hereby authorized to be expended from Fund 704, 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6631, OCA Code 644385 and Project 590401.
 
SECTION 10.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
