Rezoning Application Z24-069

 

APPLICANT:  Effler Commercial, LLC, c/o Erwin Effler III, Agent; 1391 West 5th Avenue, #250; Columbus, OH 43212.

 

PROPOSED USE:  Multi-unit residential development.

 

DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0) on February 13, 2025.

 

FIFTH BY NORTHWEST AREA COMMISSION RECOMMENDATION:  Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The 2.35± site consists of eight parcels, seven of which are developed with mixed-residential uses, one is undeveloped, all in the R-4, Residential District. The applicant also intends to purchase a portion of right-of-way south of Western Avenue. The requested AR-3, Apartment Residential District will allow for a multi-unit residential development with unlimited density. The Fifth by Northwest Neighborhood Plan (2009) recommends “Medium Density Mixed Residential” land uses, consistent with the proposed AR-3 district. Staff notes the site’s proximity to the West 5th Avenue and West King Avenue mixed-use corridors and other multi-unit residential developments directly to the west. A concurrent Council Variance (Ordinance #0539-2025; CV24-157) has been filed and includes variance to reduce the required landscaping and screening, building setback, vision clearance, lot coverage, perimeter yard, required parking, and the number of EV installed and EV capable parking spaces.

WHEREAS, application #Z24-069 is on file with the Department of Building and Zoning Services requesting rezoning of 2.35± acres from R-4, Residential District, to AR-3, Apartment Residential District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the Fifth by Northwest Area Commission recommends approval of said zoning change; and

 

WHEREAS, the City Departments recommend approval of said zoning change because the requested AR-3, Apartment Residential District will allow multi-unit residential development that is consistent with the Fifth by Northwest Neighborhood Plan and the surrounding zoning and development pattern; now, therefore:  

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

Being Lots Numbers Fourteen (14), Fifteen (15), Sixteen (16) and Seventeen (17), of DAVID M. ELLIOTT'S SUBDIVISION OF THREE (3) ACRES, parts of Lots Numbers Twelve (12), Thirteen (13), Fourteen (14) and Fifteen (15), Infirmary Farm, Clinton Township, as the same are numbered and delineated upon the recorded plat thereof, of record in Plat Book 5, page 224, Recorder's Office, Franklin County, Ohio.

 

Subject to an easement in fifteen (15) feet off the south end thereof for use as a private alley for ingress and egress for the present and all successive owners of Lot Number Eighteen (18) of said addition.
