Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into a construction contract for the Southerly Wastewater Treatment Plant Digester Rehabilitation Project for the Division of Sewerage and Drainage; appropriates the proceeds of an Ohio Water Development Authority loan; amends the 2005 Capital Improvements Budget; and authorizes the expenditure of funds from the loan for the construction contract.
 
The improvements in this project will rehabilitate six existing, forty year old sludge digestion process tanks with current process technology, and provide three additional tanks, all in order to enhance the assured wastewater treatment capacity of the Southerly plant.
 
The construction contract was advertised in the City Bulletin, and two bids were received on September 21, 2005, as follows:
 
1)  Crace Construction Co., Inc. [Majority firm] | $32,949,400.00
2)  Kokosing Construction Co., Inc. [Majority firm] | $37,712,400.00
3)  Engineer's Estimate| $39,000,000.00
 
2.  FISCAL IMPACT:
This legislation appropriates a total of $38,700,522.25 from the OWDA Loan that will be utilized for the subject project.  $5,760,122.25 is for the cost of a professional engineering services contract modification with RD Zande & Assoc., in connection with additional design services, construction management and inspection services (See Ord. 2181-2005).
 
3.  EMERGENCY DESIGNATION:
The Division of Sewerage and Drainage requests that City Council concur in the designation of this ordinance as an Emergency measure, in order to assure that the construction contract work may begin immediately to preserve the anticipated project schedule, to assure minimum final costs to the City, and to comply with the schedule commitments in the Ohio Water Development Authority loan agreement.

Body
WHEREAS, the Director of Public Utilities received two bids on September 21, 2005, for the Southerly Wastewater Treatment Plant, Digester Rehabilitation Project; and
 
WHEREAS, the bids received on September 21, 2005, have been evaluated and an award of construction contract is recommended; and
 
WHEREAS, the Ohio Water Development Authority (OWDA) approved a loan to the City of Columbus on December 15, 2005, in the amount of $39,800,066.00, identified as OWDA Loan Number 4415, for the above listed project with eligible costs including the construction contract; the professional engineering services contract modification that includes construction management and inspection services and additional professional engineering design services; and capitalized interest; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to execute a contract for the construction of the Southerly Wastewater Treatment Plant Digester Rehabilitation Project; to appropriate the proceeds from the aforementioned loan; to amend the 2005 Capital Improvements Budget, in order to assure compliance with the scheduling commitments contained in the loan agreement between the City and OWDA as administered by Ohio EPA; for the immediate preservation of the public peace, health, property, and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the proceeds from the OhioWater Development Authority Loan No. 4415, for the Southerly Wastewater Treatment Plant, Digester Rehabilitation Project; and funds from the unappropriated monies in Fund No. 666, the amount of $38,700,522.25 for the cost of a professional engineering services contract modification that includes additional design services, construction administration and inspection services; and the cost of the construction contract, is hereby appropriated to the Division of Sewerage and Drainage as follows:

Section 2.  That the Director of Public Utilities be, and hereby is, authorized to enter into contract with Crace Construction Co., Inc., P.O. Box 535, 316 Main Street, Piketon OH 45661, for the Southerly Wastewater Treatment Plant, Digester Rehabilitation Project, for the Division of Sewerage and Drainage, in accordance with the terms and conditions as shown on the contract on file in the office of the Division of Sewerage and Drainage.
 
Section 3.  That for the purpose of paying the cost of the construction contract, the expenditure of $32,940,400.00, or so much thereof as may be needed, is hereby authorized from the Ohio Water Pollution Control Loan Fund as follows:

Section 4.  That the 2005 Capital Improvements Budget Ordinance No. 1943-2005 is hereby amended as follows, to provide sufficient budget authority for the proposed expenditures associated with the aforementioned loan, associated with the Southerly Wastewater Treatment Plant Digester Rehabilitation project:

Section 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
