Explanation
BACKGROUND: This legislation is to authorize the Director of the Department of Technology to modify contract CT-19272 with Oracle Corporation for the maintenance renewal of software support and upgrades.
This server base license supports business management applications utilized Citywide and it has given the City the capability to Web enable applications for citizens use; ensure compliance with licensing agreements; provide access to information faster, securely, reliably and economically.
The passage of this ordinance will allow the Department of Technology to continue receiving software upgrades and support from the manufacturer, to continue with improvement of application and database performance for a coverage period from May 30, 2003 to May 31, 2004.
FISCAL IMPACT: In fiscal year 2000, the City expended $316,649.00 for the concurrent users license agreement. During 2001, $417,949.00 was expended for the same service. During the fiscal year of 2002 a contract modification was executed expending the amount of $451,542.00 and converting the license agreement to a server base license agreement, resulting in a 1.2 million dollars savings over a period of four years. Adequate funding for services, in the amount of $423,154.47, provided by the Oracle Corporation is available in the 2003 budget, within the Information Services Fund.
EMERGENCY: Emergency legislation is requested to continued uninterrupted services.

Title
To authorize the Director of the Department of Technology to modify a contract with Oracle Corporation for the purchase of software maintenance and support and to authorize the expenditure of $423,154.47 from the Information Services Fund, and to declare an emergency. ($423,154.47)

WHEREAS, this legislation is to authorize the Director of the Department of Technology to modify contract CT-19272 with Oracle Corporation for the maintenance renewal of software support and upgrades; and
WHEREAS, converting the license agreement, resulted in a 1.2 million dollars savings over a period of four years, that began in fiscal year 2003; and
WHEREAS, an unlimited number of users are able to access programs linked to Oracle applications, versus a limited user access; and
WHEREAS, while at the same time this server base license gives the City the capability to web enable these applications for citizens use; and
WHEREAS, it is in the best interest of the City to modify CT-19272 to continue support and the ability to receive upgrades of current applications and programs such as; Performance Series, GIS, Open Data, Income Tax and BSD applications; and
WHEREAS, an emergency exits in the usual daily operation of the Department of Technology in that it is immediately necessary to modify a contract with Oracle Corporation thereby preserving the public health, peace, property and safety; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1 That the Director of the Department of Technology be and is hereby authorized to modify and extend CT-19272 for the renewal of software support services from Oracle Corporation in order to continue the support of existing applications and programs; such as Income Tax, GIS, Performance Series and Open Data, in the amount of $423,154.47.
SECTION 2. That the expenditure of $423,154.47 or so much thereof as may be necessary is hereby authorized to be expended from:
