Explanation
 
1.      BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a construction contract with Elford, Inc. for construction services for the Jackson Pike Wastewater Treatment Plant (JPWWTP) Maintenance Building Renovation Project. Renovations to the Maintenance Building; and other such work as may be necessary to complete the contract in accordance with the plans and specifications set forth in the Bid Submittal Documents. These renovations will bring the building into compliance with ADA and current building code requirements; install energy efficient lighting, improve HVAC equipment, add on-demand hot water system, and include water conservation plumbing fixtures.
 
2.      PROJECT TIMELINE: The work under this contract shall be completed in a manner acceptable to the City within 180 calendar days from the date of the Notice to Proceed (NTP) is given by the City of Columbus.
 
3.      PROCUREMENT:  The Division advertised for competitive bid proposals on the City of Columbus's Vendor Services website and in the City Bulletin in accordance with the provisions of Section 329.09 of Columbus City Codes.  The Division of Sewerage and Drainage opened the responding bids on February 12, 2014 from the following companies:

4.      EMERGENCY DESIGNATION: An emergency designation is not requested at this time to enable the project to commence at the earliest time.
 
5.      CONTRACT COMPIANCE NO: 31-4371060 | MAJ | Exp. 03/12/2015.
This company is not debarred according to the Federal Excluded Parties Listing or prohibited from being awarded a contract according to the Auditor of State's Unresolved Findings for recovery search.
 
6.      ECONOMIC / ENVIRONMENTAL IMPACT: The economic advantage of this project will be the replacement of existing facilities with energy efficient lighting, HVAC equipment, an on-demand hot water system, water conservation plumbing fixtures and provides a safer work environment for personnel. The environmental advantage of this project is the removal of asbestos containing materials, providing energy efficient lighting, HVAC equipment, an on-demand hot water system, and water conservation plumbing fixtures. In addition, the project provides compliance with ADA and current building code requirements for the project area. No community outreach factors are considered for this project.
7.      FISCAL IMPACT: This ordinance authorizes the transfer within and expenditure up to $470,848.40 from the Sanitary Sewer General Obligation Bond Fund, Fund 664, for the JPWWTP Maintenance Building Renovation Project and to amend the 2014 Capital Improvements Budget.

WHEREAS, in accordance with the provisions of Section 329.09 of the Columbus City Codes, two bids were submitted and opened on February 12, 2014 at the office of the Director of Public Utilities; and
 
WHEREAS, the Division of Sewerage and Drainage reviewed and ranked each bid utilizing the Bid Tab and Quality Factor Form evaluation process. After careful consideration, it was recommended that Elford, Inc. be awarded the construction contract for the Jackson Pike Wastewater Treatment Plant (JPWWTP) Maintenance Building Renovation Project; and
 
WHEREAS, the work shall be completed in a manner acceptable to the City within 180 calendar days from the date of the Notice to Proceed; and
 
WHEREAS, it is necessary for City Council to authorize the transfer within and expenditure up to $470,848.40 from the Sanitary Sewer General Obligation Bond Fund, Fund 664; and
 
WHEREAS, it is necessary to authorize an amendment to the 2014 Capital Improvement Budget for purposes of creating and providing sufficient budget authority for the aforementioned expenditure; and
 
WHEREAS, the Department of Public Utilities Division of Sewerage and Drainage is requesting that this Council authorize the Director of Public Utilities to enter into a construction contract with Elford, Inc. for construction services for the Jackson Pike Wastewater Treatment Plant (JPWWTP) Maintenance Building Renovation Project at the earliest practical date; Now, Therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That the Director of Public Utilities be, and hereby is, authorized to enter into a construction contract with Elford, Inc., 1220 Dublin Road, Columbus, Ohio 43215, for the Jackson Pike Wastewater Treatment Plant (JPWWTP) Maintenance Building Renovation Project, in accordance with the terms and conditions as shown in the contract on file in the office of the Division of Sewerage and Drainage.
 
SECTION 2. That the City Auditor is hereby authorized to transfer $470,848.40 within the Department of Public Utilities, Division of Sewerage and Drainage | Dept. /Div. No. 60-05 | Sewerage and Drainage Sanitary Sewer General Obligation Bond Fund | Fund 664 | Object Level Three 6624, as follows:

SECTION 3. That the Director of Public Utilities be and hereby is authorized to expend up to a total of $470,848.40 in the following manner:

SECTION 5.   That the said firm, Elford, Inc., shall perform the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
 
SECTION 6.   That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.  
 
SECTION 7. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
 
SECTION 8.  That the City Auditor is hereby authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 9.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
