Explanation
 
Background:The Rocky Fork-Blacklick Accord is a joint planning initiative by the City of Columbus and the Village of New Albany to help guide physical development in northeastern Franklin County.  The Accord was adopted on January 27, 1997 by Ordinance 11-97 and subsequently amended in 1999 and 2001.  While based on a twenty-year planning horizon, the Accord was not meant to serve without revision. Changing conditions in the area require that current provisions of the Accord be updated.  These conditions include a 2001 modification of the Columbus/New Albany sewer agreement, annexation activity in the area, the 2001 adoption of the Traditional Neighborhood Development Article, and the emerging concept of a substantial Metro Park in the planning area.
 
This ordinance adopts an update of the Accord including revised land use recommendations and development standards.  The Rocky Fork-Blacklick Accord Implementation Panel has recommended approval of the proposed update. The update was also submitted to and approved by the Columbus Development Commission at their November 20, 2003 Policy meeting.  The Village of New Albany is currently considering adoption of this revision as well.
 
Fiscal Impact: No funding is required for this legislation.

Body
 
WHEREAS, the Rocky Fork-Blacklick Accord was adopted on January 27, 1997 by Ordinance 11-97 and subsequently amended in 1999 and 2001; and
 
WHEREAS, the Rocky Fork-Blacklick Accord while based on a twenty-year planning horizon, was not meant to serve without revision as a guide for development in northeast Franklin County throughout that period; and
 
WHEREAS, changing conditions in the area require that current provisions of the Accord be updated; and
 
WHEREAS, the Rocky Fork-Blacklick Accord Implementation Panel held public meetings and recommended approval of the revision to the Accord document; and
 
WHEREAS, the Village of New Albany is also in the process of approving the revision to the Rocky Fork-Blacklick Accord contained herein; and
 
WHEREAS, a public hearing was held at which time the Development Commission recommended adoption of this revision; now, therefore,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.      That the update to the Rocky Fork-Blacklick Accord is hereby adopted as revisions to the Rocky Fork-Blacklick Accord.
 
Section 2.      That the Development Commission and departments and divisions of the City administration are hereby authorized and directed to use the Rocky Fork-Blacklick Accord Update to initiate or review proposed projects in the subject area and to require that such proposals generally conform to said Accord plan.
 
Section 3.      That the Department of Development is directed to monitor the use of this revision, and to present to City Council any modifications necessary to keep it up to date.
 
Section 4.      That copies of the updated Rocky Fork-Blacklick Accord shall be kept on file in the Department of Development, Planning Division.
 
Section 5.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
