Explanation
 
1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to execute a contract with Reynolds Inliner, LLC, for the construction of the Como/Milton Area Sanitary Sewer Improvements Project.  This project will rehabilitate approximately 11,364 lineal feet of eight to 18-inch diameter sanitary sewer lines, utilizing Cured-in-Place Pipe (CIPP), serving homes within the project area that is located in the Clintonville Community.  This contract will include cleaning, video inspection, lateral sewer reestablishment, bypass pumping, maintenance of traffic, open cut point repairs and other associated work.  This project will also include the replacement of 571 feet of 18-inch diameter sanitary sewer, and the installation of 7 new sanitary manholes, the installation of two new storm manholes, the installation of an inline check valve, and the rehabilitation of 56 manholes, including the replacement of the frames and covers for 50 manholes, cementitious lining on 56 manholes, and the installation of a flexible manhole sealant coating on all new rehabilitated manholes and other such work as may be necessary to complete the contract in accordance with the plans (CC-14051) and specifications.
 
The Director of Public Utilities publicly opened three competitive bid proposals on June 27, 2007.  The cumulative results of these bids were: Reynolds Inliner submitted a bid of $1,403,582.10; Insituform Technologies, Inc., submitted a bid of $1,581,565.93; Kokosing Construction submitted a bid of $2,164,223.65.  The Engineer's Estimate for this project was $1,279,000.00.

3.  FISCAL IMPACT:  This ordinance authorizes the transfer and appropriation of funds from the Sewer System Reserve Fund to the OWDA Loan Fund in order to fund this proposed expenditure.  This transaction is a temporary measure that is required until such time as the Department is able to execute a loan agreement with the Ohio Water Development Authority and reimburse the Sewer System Reserve Fund.

Body
WHEREAS, three competitive bids for the construction of the Como/Milton Area Sanitary Sewer Improvements Project, were received on June 27, 2007; and
 
WHEREAS, it is necessary for the City Council to both appropriate funds from the Sewer System Reserve Fund and authorize the transfer of said funds into the Ohio Water Development Authority Loan Fund; in order to temporarily fund this expenditure, until such time as the City is able to execute a loan for the above stated purpose and reimburse the Sewer System Reserve Fund;  and Now, Therefore
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Utilities in that it is immediately necessary to pass this ordinance as an emergency measure because of the need to complete the design and construction projects on time; for the preservation of the public health, peace, property, safety, and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That from the unappropriated monies in the Sewer System Reserve Fund 654, and from all monies estimated to come into said fund from any and all sources, and unappropriated from any other purpose for the Como/Milton Area Sanitary Sewer Improvements Project, the sum of $1,403,582.10 is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05 | Object Level One 10 | Object Level Three 5502 | OCA Code 901654.
 
Section 2.  That the City Auditor is hereby authorized to transfer $1,403,582.10 to the OWDA Loan Fund No. 666, into the appropriate project accounts as specified within Section 3 herein, at such time as deemed necessary by him, and to expend said funds, or so much thereof as may be necessary.
 
Section 3.  That the expenditure of $1,403,582.10 is hereby appropriated for the Como/Milton Area Sanitary Sewer Improvement project within the OWDA Loan Fund No. 666 | Division 60-05 | as follows:

Section 4.  That upon obtaining other funds for the purpose of funding sanitary sewer system capital improvement work, the City Auditor is hereby authorized to repay the Sewer System Reserve Fund the amount transferred under Section 2., above, and said funds are hereby deemed appropriated for such purposes.
 
Section 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modifications associated with the expenditure of the funds transferred under Section 2., above.
 
Section 6.  That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for the construction of the Como/Milton Area Sanitary Sewer Improvements Project with the lowest, and best bidder, Reynolds Inliner, LLC., 4520 N. Sate Road 37, Orleans, IN 47452-0186 in the amount of $1,403,582.10 in accordance with the terms and conditions of the Contract on file in the Sewer System Engineering Section Office of the Division of Sewerage and Drainage.
 
Section 7.  That the expenditure of $1,403,582.10, or as much thereof as may be needed, is hereby authorized from the OWDA Loan Fund No. 666 | Division 60-05 | as follows:

Section 8.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
