Background:

 

     The following is a resolution to declare the necessity and intent to appropriate fee simple title and lesser interests in and to real estate in connection with the Hague Avenue Stormwater System Improvement Project.

Emergency Justification:

 

     Emergency action is requested to allow the acquisition of the parcels necessary for this project to proceed without delay, thus facilitating the commencement of construction necessary to the project.

 

 

 

Title

 

To declare the necessity and intent to appropriate fee simple title and lesser interests in and to real estate in connection with the Hague Avenue Stormwater System Improvement Project, and to declare an emergency.

 

 

Body

 

WHEREAS,                     the City of Columbus is engaged in the Hague Avenue Stormwater System Improvement Project; and

 

WHEREAS,                     an emergency exists in the usual daily operation of the Department of Public Utilities, Division Sewerage and Drainage, in that it is immediately necessary to declare the necessity and intent to appropriate fee simple title and lesser interests in and to the hereinbefore described real estate necessary for the aforementioned project so that there will be no delay in the project thereby preserving the public health, peace, property, safety, and welfare; now, therefore:

 

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

                     Section 1.                     That this Council hereby declares the necessity and intent to appropriate fee simple title and lesser interests in and to the following described real estate necessary for the Hague Avenue Stormwater System Improvement Project, Project # 610963, pursuant to and in accordance with the Charter of the City of Columbus, Columbus City Code (1959) Revised, Chapter 909, the Constitution of the State of Ohio and Ohio Revised Code, Chapter 719; to-wit:

Situated in the County of Franklin, in the State of Ohio and in the City of Columbus and being part of parcel number 140-000096 as owned by Norfolk Southern Railroad Company.  All references refer to the records of Franklin County Auditor located in Columbus, Ohio.

                     This parcel is located approximately 0.3 miles west of R.R. mile ″142″ and 1800 feet west of the North Hague Avenue railroad crossing and being more particularly described as follows:

                     Beginning at an iron pin found in the northwest corner of parcel number 010-121702 as owned by Robert Owen Snyder and Marilyn Joan Snyder, husband and wife.  Said pin being also in the south right-of-way line of said Norfolk Southern Railroad Company; thence along the said south right-of-way line and along the north line of said Snyder parcel N 86°30'00" E, 15 feet to a point; thence across the said railroad right-of-way N 3°51′00″W, 100 feet to a point, said point being in the north right-of-way line of said railroad and also being in the south line of parcel number 570-148058 as owned by Three Cousins Ltd. Partnership; thence with said north right-of-way line S 86°30′00W″, 20 feet to a point; thence across the said railroad right-of-way S 3°51′00″ E, 100 feet to point, said point being in the south right-of-way line of said railroad; thence with the said south right-of-way line N 86°30′00″ 5 feet to point of beginning containing O.046 acres.

                     Beginning at an iron pin in the northwest corner of said 0.837 acre tract; thence along the westerly line of said tract, South 3° 51′ East, 150.01 feet to an iron pin, in the southwest corner of said 0.837 acre tract; thence along the southerly line of said tract, North 86° 30′ East, 110.11 feet to a point, said point being in the westerly right-of-way line of a cul-de-sac in Dibblee Avenue; thence along said westerly right-of-way line with a curve to the right having a 50 feet radius, North 41° 10′ 49″ East 14.06 feet along a chord to a point;  thence along a line parallel and 10.00 feet North of said southerly line,  South 86° 30′ 00″ west 110.06 feet to a point; thence along a line parallel and 10.00 feet East of said westerly line, North 3° 51′ 00″  West 140.01 feet to a point, said point being in the northerly line of said 0.837 acre tract; thence along said northerly line South 86° 30′ 00″ West 10.00 feet to a point of beginning containing 0.058 acre more or less.

                     Section 2.                     That the City Attorney be and hereby is authorized to cause a written notice of the adoption of this resolution to be served upon the owners, persons in possession of or persons having a real or possible interest of record in the above described premises in the manner provided by law.

 

                     Section 3.                     That for the reasons state in the preamble hereto, which is hereby made a part hereof, this resolution is declared to be an emergency measure and shall take effect and be in force from and after its adoption and approval by the Mayor, or ten days after adoption if the Mayor neither approves nor vetoes the same.
