Explanation
BACKGROUND:
This ordinance makes minor changes to the Columbus Zoning Code to correct a codification error. The word "fringe" was inadvertently included in a section of code that was written to regulate the floodway portion of the floodplain and not the floodway fringe.
The accidental addition of the word "fringe" to this portion of code creates confusion as to what portion of the floodplain these specific regulations cover, and as such, the removal will remove any vagueness and add clarity to the aforementioned regulations.

Title
To amend section 1150.19 of Columbus City Codes, Chapter 1150, "Floodplain Management," in order to remove the word "fringe" from the description of the floodway which was inadvertently included in a code section that contains use restrictions relating only to the floodway and not the floodway fring; and to repeal existing section 1150.19 of the Columbus City Codes, 1959.

WHEREAS, this ordinance makes minor changes to the Columbus Zoning Code to correct a codification error; and
WHEREAS, the word "fringe" was inadvertently included in a section of code that was written to regulate the floodway portion of the floodplain and not the floodway fringe; and
WHEREAS, the accidental addition of the word "fringe" to this portion of code creates confusion as to what portion of the floodplain these specific regulations cover, and as such, the removal will remove any vagueness and add clarity to the aforementioned regulations; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
Section 1. That the existing section 1150.19 of the Columbus City Codes, 1959, is hereby amended to read as follows:
1150.19 Activities, development, and uses in the floodway
Only one or more of the following activities may be allowed in the floodway fringe, provided it complies with all standards of the Columbus City Codes:
A. Reforestation, wetland restoration or banking, and conservation projects;
B. Recreation trails, passive recreational use, and access thereto;
C. Bridges when constructed above the flood protection elevation or as approved by FEMA, storm water outfall, underground utility crossings, streets and railroads not requiring fill, and stream crossings;
D. Temporary construction activity only for the maintenance and/or repair of permitted activities, development, and/or uses; and
Within the floodway, no building, structure or premises shall be used, and no building or structure shall be erected which is designed to be used for human habitation.
Section 2. That prior existing section 1150.19 of the Columbus City Codes, 1959, is hereby repealed.
Section 3 That this ordinance shall take effect and be in force from and after the earliest period provided by law.
