Title: To authorize the Public Service Director to execute those documents necessary to exchange various tracts of real property in connection with the extension of Schofield Drive, north of State Route 161; to dedicate and name the additional right-of-way received by the City as Schofield Drive; to waive the Land Review Commission provisions of the Columbus City Codes (1959); and to declare an emergency. Explanation
 
The Ohio Department of Transportation (ODOT) constructed a portion of that road identified as Schofield Drive as a part of the S.R. 161 project.  Subsequent to the S.R. 161 project construction local developers proposed a publicly dedicated extension of Schofield Drive.  Certain design changes were made during the planning of the extension to provide access to all abutting owners and a portion of Schofield Drive was realigned.  As a result of the realignment, it has been determined that certain tracts of right-of-way previously dedicated to ODOT as right-of-way are to be returned to the property owners that originally dedicated the right-of-way and that replacement right-of-way necessary for the new alignment must be transferred to ODOT and the City.
 
This legislation authorizes the Public Service Director to execute those documents necessary to convey various tracts of real property, more fully described in the body of this legislation, and to accept replacement right-of-way, more fully described in the body of this legislation on behalf of the City.
 
Emergency action is requested to allow the previously constructed extension of Schofield Drive to be accepted, dedicated and officially named without delay.

Body
 
WHEREAS, to accommodate certain design changes made during the planning of the extension of Schofield Drive, north of State Route 161, it is necessary for the City of Columbus to accept certain parcels from the Ohio Department of Transportation and to convey a number of real properties to and from various property owners; and
 
WHEREAS, an emergency exists in the usual daily operation of the City of Columbus, in that it is immediately necessary to authorize the Public Service Director to execute various documents necessary to convey a number of real properties to various property owners to accommodate design changes made during the planning of the extension of Schofield Drive, north of State Route 161, and to accept, on behalf of the City of Columbus, various parcels of replacement right-of-way for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Public Service Director be and is hereby authorized to accept Quitclaim Deeds from the Ohio Department of Transportation for the following described real property:
 
Parcel "A" 0.399 Acres
Situated in the State of Ohio, County of Franklin, City of Columbus, Quarter Township 3, Township 2, Range 16 and being 0.399 acres out of a 0.702 acre tract of land as conveyed to the State of Ohio Department of Transportation, Parcel 1WD as recorded in Instrument Number 199812160324044 (all records being of the Recorder's Office, Franklin County, Ohio) and being more particularly described as follows;
Beginning for reference at the northeasterly corner limited access right of way line of State Route 161, Station 988+06.93, 633.63 feet left as measured at right angles to the centerline of said State Route 161 as shown on the Centerline Survey Plat FRA-161-16.75, Lic.-161-0.00 as recorded in Book 78, Page 28 and being a point on the westerly line of a 3.554 acre tract as conveyed to Daniel J. Section 7.  That this Council has determined it is in the best interest of the City of Columbus to allow this excess right-of-way to be transferred without requiring competitive bidding and hereby waives the competitive bidding provision of Columbus City Codes (1959) Revised, Section 329.29 with regards to the transfer of these properties.
 
Section 8.  That for the reasons state in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
