Background: This ordinance authorizes the Director of the Department of Development, or his designee, to execute and acknowledge those documents, as approved by the Department of Law, Real Estate Division, necessary to grant fee simple title to the Board of County Commissioners, Franklin County, Ohio (“Franklin County”) to an approximate 0.124 acre tract of property identified as Parcel 17WD (“Parcel 17WD”) of Franklin County’s FRA CR 171-0.00 Innis Sidewalks Project (“Project”), to be split from that city-owned real property located at 2035 Innis Road Rear, Columbus, Ohio 43224 and identified as Franklin County Tax Parcel 010-087437 (“Property”).
The Property is managed by the City’s Recreation and Parks Department (“CRPD”) and is commonly known as the Green Line Linear Park. CRPD reviewed the request and determined that the project benefits the community and, in the interest of inter-governmental cooperation, should be quitclaimed to Franklin County at no cost. The Property was purchased by CRPD using grants funds from the Ohio Public Works Commission (“OPWC”) and is burdened by a Declaration of Restrictions recorded in Instrument Number 202402010010394, Recorder’s Office, Franklin County, Ohio. CRPD sought approval from OPWC to donate Parcel 17WD to Franklin County and, in a letter dated January 2, 2026, attached hereto as Exhibit B, and fully incorporated for reference as if rewritten, OPWC authorized the transfer to Franklin County.

Emergency Justification: Emergency action is requested to allow Franklin County’s project to move forward in a timely manner and meet their end of February timeline for property acquisition so as to not delay their project.

To authorize the Director of the Department of Development, or his designee, to execute and acknowledge those documents, as approved by the Department of Law, Real Estate Division, necessary to grant, at no cost, fee simple title to the Board of County Commissioners, Franklin County, Ohio to an approximate 0.124 acre tract of property to be split from that city-owned real property, and to declare an emergency. WHEREAS, the City owns real property located at 2035 Innis Road Rear, Columbus, Ohio 43224 and identified as Franklin County Tax Parcel 010-087437 (“Property”) that is managed by the Recreation and Parks Department (“CRPD”) and is commonly known as the Green Line Linear Park; and
WHEREAS, Franklin County is currently working on the FRA CR 171-0.00 Innis Sidewalks Project (“Project”) and as part of the Project Franklin County needs to acquire Parcel 17WD, a 0.124 acre portion of the Property from the City; and
WHEREAS, it has been determined that, in the interest of inter-governmental cooperation, it is in the best interest of both the City and Franklin County to transfer Parcel 17WD at no cost; and
WHEREAS, an emergency exists in the usual daily operation of the City, in that it is immediately necessary to authorize the Director of the Department of Development, or his designee, to execute at the earliest feasible date, those documents necessary to grant a quitclaim deed to the Board of County Commissioners, Franklin County, Ohio an approximately 0.124 acre property to be split from that city-owned real property located at 2035 Innis Road Rear, Columbus, Ohio 43224 and identified as Franklin County Tax Parcel 010-087437 thereby immediately preserving the public health, peace, property, safety, and welfare; and now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Development, or his designee, be and hereby is, authorized to execute and acknowledge those documents, as approved by the Department of Law, Real Estate Division, necessary to transfer at no cost an approximately 0.124 acre portion of the City’s real property, described and depicted in the Three (3) page attachment, Exhibit A, which is fully incorporated for reference as if rewritten, and identified as Parcel 17WD on Franklin County’s FRA CR 171-0.00 Innis Sidewalk Project, located at 2035 Innis Road Rear, Columbus, Ohio 43224 and identified as Franklin County Tax Parcel 010-087437 to the Board of County Commissioners, Franklin County, Ohio.
SECTION 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
