Explanation
Background: Scitech is a cooperative effort to bring high tech research and development enterprises into the OSU Science and Technology Campus located on 37 acres of state owned property along Kinnear Road. This area is deficient in water service which is holding back expansion and construction of new buildings. This project involves planning, designing and constructing a new 16 inch water main to provide the water service necessary to allow Scitech to build new research and development facilities. Currently, Scitech is planning two new buildings, the Electrical Engineering Research Laboratory and a 3-story, multi-tenant facility.
Fiscal Impact: $350,000 is available in the 2005 Capital Improvement Budget.

To authorize the Director of the Department of Development to enter into a Guaranteed Maximum Price Reimbursement Agreement with Scitech Corporation to plan, design and construct a new water main on Kinnear Road; to authorize the expenditure of up to $350,000 from the Capital Fund; and to waive the competitive bidding provisions of Chapter 329 of the Columbus City Codes; and to declare an emergency. WHEREAS, Scitech works in collaborations to bring high tech and research jobs to Columbus; and
WHEREAS, Scitech is planning two new buildings to accommodate new research facilities, the Electrical Engineering Research Laboratory and a multi-tenant facility; and
WHEREAS, A lack of water pressure is preventing any expansion of this Science and Technology Campus; and
WHEREAS, this project involves planning, designing and constructing a new 16 inch water main to provide the water service necessary to allow Scitech to build new research and development facilities; and
WHEREAS, the Development Department feels it is necessary to complete this work as a benefit to Columbus's workforce and its residents; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to enter into a Guaranteed Maximum Price Reimbursement agreement with Scitech Corporation for the above stated purpose, thereby preserving the public health, peace, property, safety, and welfare, and; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Department of Development be authorized to enter into a Reimbursement Agreement with Scitech Corporation for $350,000 to complete planning, designing and constructing of a new 16" water main to serve expansion of the Science and Technology Campus on Kinnear Road.
Section 2. That for the purpose stated in Section 1, the expenditure of up to $350,000 from the Development Department, Division No. 44-01, Fund No. 742, Project No. 440112 Scitech Water Line Improvements, OCA Code 643106, Object Level Three 6680 is hereby authorized.
Section 3. That the formal consultant selection process provisions of Chapter 329 of the City Code be and hereby are waived.
Section 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this legislation is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
